49 U.S.C. § 40115 — Withholding information

A person can object in writing to releasing certain filed or collected information. The Secretary must withhold it if release would hurt U.S. talks or an airline's foreign competitiveness. This section never lets information be kept from an authorized congressional committee.
(a) Objections to Disclosure. (1) A person can object to the public release of information (A) in a record filed under this part, or (B) that the Secretary of Transportation or State, or the U.S. Postal Service, collected under this part. (2) The objection must be written and explain the reasons. The relevant Secretary or the Postal Service must then order the information withheld if releasing it would (A) hurt the U.S. government's position in international negotiations, or (B) hurt an airline's ability to compete in international air travel.
(b) Withholding Information From Congress. Nothing in this section lets information be kept from a congressional committee that is authorized to receive it.
A person may object to the public disclosure of information—
in a record filed under this part; or
obtained under this part by the Secretary of Transportation or State or the United States Postal Service.
An objection must be in writing and must state the reasons for the objection. The Secretary of Transportation or State or the Postal Service shall order the information withheld from public disclosure when the appropriate Secretary or the Postal Service decides that disclosure of the information would—
prejudice the United States Government in preparing and presenting its position in international negotiations; or
have an adverse effect on the competitive position of an air carrier in foreign air transportation.
This section does not authorize information to be withheld from a committee of Congress authorized to have the information.
