49 U.S.C. § 41305 — Applications for permits

A person who wants a permit under section 41302 must apply in writing to the Secretary of Transportation. The application must be verified, follow the Secretary's rules, and be served on interested people. The Secretary posts notice of the application and lets interested people respond before deciding.
(a) Applying for a permit. (1) A person must apply in writing to the Secretary of Transportation for a permit under section 41302. The Secretary's regulations require the application to be (A) verified, (B) in a set form with set information, (C) served on interested persons, and (D) filed along with proof that it was served. (2) Once filed, the Secretary posts notice of the application and gives notice to others as required by regulation. An interested person may file a response supporting or opposing the permit. The Secretary must act on the application as quickly as possible.
(b) Terms of the permit. The Secretary may attach terms to the permit that the Secretary finds are needed in the public interest for providing the foreign air transportation.
A person must apply in writing to the Secretary of Transportation to be issued a permit under section 41302 of this title. The Secretary shall prescribe regulations to require that the application be—
verified;
in a certain form and contain certain information;
served on interested persons; and
accompanied by proof of service on those persons.
When an application is filed, the Secretary shall post a notice of the application in the office of the Secretary and give notice of the application to other persons as required by regulations of the Secretary. An interested person may file a response with the Secretary opposing or supporting the issuance of the permit. The Secretary shall act on an application as expeditiously as possible.
The Secretary may impose terms for providing foreign air transportation under the permit that the Secretary finds may be required in the public interest.
