A person who knowingly or willfully violates section 40103(b)(3), or a regulation or order issued under that section, may be fined or imprisoned. A second or later conviction under this section can result in up to 5 years in prison.
A person who knowingly or willfully violates section 40103(b)(3) — the rule on national defense airspace — or a regulation or order issued under it, is fined under title 18, imprisoned up to 1 year, or both.
If someone is convicted of a second or later offense under this section, the punishment rises to imprisonment for up to 5 years, a fine under title 18, or both.
A person that knowingly or willfully violates section 40103(b)(3) of this title or a regulation prescribed or order issued under section 40103(b)(3) shall be fined under title 18, imprisoned for not more than one year, or both. If a person is convicted of a second or subsequent offense under this section, the punishment shall be imprisonment for not more than 5 years, a fine under title 18, or both.
