submitted 60 years ago by Pub. L. 89-554 to r/title-5-GOVERNMENT-ORGANIZATION-AND-EMPLOYEES · 165 words · no verdicts yet

in plain englishAI-generated · not legal advice

The President may place up to 34 additional positions in Levels IV and V of the Executive Schedule when organizational or workload changes make that necessary. The statute also sets limits and notice rules for those decisions.

In addition to positions listed in sections 5315 and 5316, the President may sometimes place positions held by no more than 34 people in Levels IV or V when the President considers it necessary because an Executive agency’s organization, management duties, or workload has changed. For a position filled by presidential appointment with Senate advice and consent, the change takes effect only when a new appointment is made. Each action must be published in the Federal Register unless the President decides publication would harm national security. The President may not use this section for a position whose pay is set at a specific rate by this subchapter or by a law enacted after August 14, 1964.
