5 U.S.C. § 5567 — Settlement of accounts
submitted 60 years ago by Pub. L. 89-554 to r/title-5-GOVERNMENT-ORGANIZATION-AND-EMPLOYEES · 210 words · no verdicts yet
The agency head may settle certain employee and casualty-survivor accounts, and that settlement binds United States accounting officials. The section provides limited protection for erroneous payments made without fraud or criminal conduct.
(a) The agency head or designee may settle accounts of (1) an employee for whose account payment was made under sections 5562, 5563, and 5565, and (2) a survivor of a casualty to a ship, station, or military installation that lost or destroyed disbursing records. The settlement is conclusive for United States accounting officials. (b) A payment or settlement based on a death report, decision, or finding cannot be recovered or reopened merely because a later report or decision fixes a death date. But the account must be reopened using a later date if it is later than the date used before. (c) A disbursing official gets credit for an erroneous or excessive payment made under this subchapter, except section 5568, if the official committed no fraud or criminal conduct. An authorizing individual cannot be required to repay a payment under this subchapter, except section 5568, if that individual committed no fraud or criminal conduct.
The head of the agency concerned or his designee may settle the accounts of—
an employee for whose account payment has been made under sections 5562, 5563, and 5565 of this title; and
a survivor of a casualty to a ship, station, or military installation which results in the loss or destruction of disbursing records.
That settlement is conclusive on the accounting officials of the United States in settling the accounts of disbursing officials.
Payment or settlement of an account made pursuant to a report, determination, or finding of death may not be recovered or reopened because of a later report or determination which fixes a date of death. However, an account shall be reopened and settled on the basis of a date of death so fixed which is later than that used as a basis for earlier settlement.
In settling the accounts of a disbursing official, he is entitled to credit for an erroneous payment or overpayment made by him in carrying out this subchapter, except section 5568, if there is no fraud or criminality by him. Recovery may not be made from an individual who authorizes a payment under this subchapter, except section 5568, if there is no fraud or criminality by him.
