5 U.S.C. § 6324 — Absence of certain police and firemen

Certain District of Columbia and Federal police and firefighters do not have sick leave charged for duty-related injury or illness. The responsible authority must decide whether the injury or illness was duty-related under regulations, subject to an exception for certain Secret Service employees.
(a) Sick leave may not be charged to a member of the District of Columbia Metropolitan Police or Fire Department, the United States Park Police, or the Secret Service Uniformed Division for an absence caused by an injury or illness resulting from duty.
(b) Regulations must govern that determination. The District of Columbia Council prescribes them for its Metropolitan Police and Fire Department members; the Secretary of the Interior prescribes them for United States Park Police; and the Secretary of Homeland Security prescribes them for Secret Service Uniformed Division members.
(c) This section does not apply to Secret Service Uniformed Division members covered by chapter 84 for retirement benefits.
Sick leave may not be charged to the account of a member of the Metropolitan Police force or the Fire Department of the District of Columbia, the United States Park Police force, or the United States Secret Service Uniformed Division for an absence due to injury or illness resulting from the performance of duty.
The determination of whether an injury or illness resulted from the performance of duty shall be made under regulations prescribed by—
the District of Columbia Council for members of the Metropolitan Police force and the Fire Department of the District of Columbia;
the Secretary of the Interior for the United States Park Police force; and
the Secretary of Homeland Security for the United States Secret Service Uniformed Division.
This section shall not apply to members of the United States Secret Service Uniformed Division who are covered under chapter 84 for the purpose of retirement benefits.
