Despite section 801, certain rules may take effect when the issuing Federal agency decides. These are certain hunting, fishing, and camping rules and rules for which the agency properly finds ordinary notice and procedure impracticable, unnecessary, or against the public interest.

Notwithstanding section 801, (1) a rule establishing, changing, opening, closing, or conducting a regulatory program for commercial, recreational, or subsistence hunting, fishing, or camping, or (2) a rule for which the agency finds good cause and states why notice and public procedure are impracticable, unnecessary, or against the public interest, takes effect at the time the issuing Federal agency determines.
