The Secretary of Labor can use the same investigative powers already granted under ERISA section 504. This lets the Secretary, or an officer the Secretary designates, check whether someone has violated, or is about to violate, section 8477 or 8478.
Any authority available to the Secretary of Labor under section 504 of the Employee* Retirement Income Security Act of 1974 is also made available to the Secretary of Labor, and to any officer the Secretary designates, to determine whether any person* has violated, or is about to violate, any provision of section 8477 or 8478.
