The FBI Director must annually report to the appropriate congressional committees on personal-services contracts under section 3072. The report covers contract counts, costs, length, services, available Government personnel, and FBI staffing efforts, with an unclassified report and possible classified annex.
(1) Within one year after December 13, 2003, and every year afterward, the FBI Director must report to the appropriate congressional committees* on using section 3072 authority.
(2) For the year ending on the report date, each report must state (A) the number of contracts entered; (B) each contract’s cost; (C) each contract’s length; (D) the service types; (E) whether United States Government personnel were available to perform similar functions; and (F) FBI efforts to fill vacancies or request more positions in intelligence* or counterintelligence* areas.
(3) The report must be unclassified but may have a classified annex.
(4) For the classified annex, “appropriate committees of Congress” means (A)(i) the Senate Select Committee on Intelligence and (ii) the House Permanent Select Committee on Intelligence. For the unclassified portion, it means those committees plus (B) the Senate Appropriations, Governmental Affairs, and Judiciary Committees and (C) the House Appropriations, Government Reform and Oversight, and Judiciary Committees. This section does not otherwise define that quoted term.
Not later than one year after December 13, 2003, and annually thereafter, the Director of the Federal Bureau of Investigation shall submit to the appropriate committees of Congress a report on the exercise of the authority in section 3072 of this title.
Each report under this section shall include, for the one-year period ending on the date of such report, the following:
The number of contracts entered into during the period.
The cost of each such contract.
The length of each such contract.
The types of services to be provided under each such contract.
The availability, if any, of United States Government personnel to perform functions similar to the services to be provided under each such contract.
The efforts of the Federal Bureau of Investigation to fill available personnel vacancies, or request additional personnel positions, in areas relating to the intelligence* or counterintelligence* mission of the Bureau.
Each report under this section shall be submitted in unclassified form, but may include a classified annex.
In this section—
for purposes of the submittal of the classified annex to any report under this section, the term “appropriate committees of Congress” means—
the Select Committee on Intelligence of the Senate; and
the Permanent Select Committee on Intelligence of the House of Representatives; and
for purposes of the submittal of the unclassified portion of any report under this section, the term “appropriate committees of Congress” means—
the committees specified in subparagraph (A);
the Committees on Appropriations, Governmental Affairs, and the Judiciary of the Senate; and
the Committees on Appropriations, Government Reform and Oversight, and the Judiciary of the House of Representatives.
