The Secretary of Defense may use Cooperative Threat Reduction funds for an unspecified purpose or exceed a specified amount under limited conditions. The Secretary must find the action in the national interest, notify the congressional defense committees, provide justification, and wait 15 days.
(a) Notice of intent to use funds for unspecified purposes. (1) For a fiscal year in which an Act other than an appropriations Act specifically authorizes Cooperative Threat Reduction funds* for Program* purposes, the Secretary of Defense may use those or other Program funds for another purpose only if (A) the Secretary finds the use necessary in U.S. national interests; (B) the Secretary gives the congressional defense committees* notice of the intent and a complete explanation and justification, including the amount; and (C) 15 days pass after submitting it. (2) This does not authorize a use specifically prohibited by section 3731 or another law.
(b) Limited authority to vary specified amounts. In such a fiscal year, the Secretary may use the funds above the authorized amount for a specified purpose only if (1) the Secretary finds it necessary in U.S. national interests; (2) the Secretary gives the committees notice of the intent and a complete justification, including the amount of the excess; and (3) 15 days pass after submission.
For any fiscal year for which Cooperative Threat Reduction funds* are specifically authorized in an Act other than an appropriations Act for specific purposes within the Program*, the Secretary of Defense may obligate or expend such funds, or other funds otherwise made available for the Program for that fiscal year, for purposes other than such specified purposes if—
the Secretary determines that such obligation or expenditure is necessary in the national interests of the United States;
the Secretary submits to the congressional defense committees*—
notification of the intent of the Secretary to make such an obligation or expenditure of funds; and
a complete discussion of the purpose and justification for such obligation or expenditure, including the amount of funds to be obligated or expended; and
a period of 15 days has elapsed following the date on which the Secretary submits the notification and discussion under subparagraph (B).
Paragraph (1) may not be construed to authorize the obligation or expenditure of Cooperative Threat Reduction Program funds for a purpose for which the obligation or expenditure of such funds is specifically prohibited under section 3731 of this title or any other provision of law.

the Secretary determines that such obligation or expenditure is necessary in the national interests of the United States;
the Secretary submits to the congressional defense committees—
notification of the intent of the Secretary to make such an obligation or expenditure of funds in excess of such authorized amount; and
