The term “continuous vetting” has the meaning given such term in Executive Order No. 13467 ( 50 U.S.C. 3161 note; relating to reforming processes for determining suitability for government employment, fitness for contractor employees, and eligibility for access to classified national security information). (4) Council

“Council” applies throughout this title

The term “Council” means the Security, Suitability, and Credentialing Performance Accountability Council established pursuant to such Executive order, or any successor entity. (5) Reciprocity

“reciprocity” applies throughout this title

The term “reciprocity” means reciprocal recognition by Federal departments and agencies of eligibility for access to classified information. (6) Security Executive Agent

“Security Executive Agent” applies throughout this title

The term “Security Executive Agent” means the officer serving as the Security Executive Agent pursuant to section 3162a of this title . (7) Suitability and Credentialing Executive Agent

“Suitability and Credentialing Executive Agent” applies throughout this title

The term “Suitability and Credentialing Executive Agent” means the Director of the Office of Personnel Management acting as the Suitability and Credentialing Executive Agent in accordance with Executive Order No. 13467 ( 50 U.S.C. 3161 note; relating to reforming processes related to suitability for Government employment, fitness for contractor employees, and eligibility for access to classified national security information), or any successor entity.

“appropriate committees of Congress” applies in that section

The term “appropriate committees of Congress” means— (A) the congressional intelligence committees; (B) the Subcommittee on Defense of the Committee on Appropriations of the Senate; and (C) the Subcommittee on Defense of the Committee on Appropriations of the House of Representatives. (2) Covered contract or agreement The term “covered contract or agreement”, with respect to an entity, means a contract or other agreement between that entity and an element of the intelligence community the performance of which requires a specified number of covered persons to hold a security clearance.

“elements of the intelligence community” applies in that section

the term “elements of the intelligence community” means the elements of the intelligence community specified or designated under section 3003(4) of this title . (b) Recommendations on agency declassification programs (1) Upon reviewing and discussing declassification plans and progress with an agency, the Board shall provide to the head of the agency the written recommendations of the Board as to how the agency’s declassification program could be improved. A copy of each recommendation shall also be submitted to the Assistant to the President for National Security Affairs and the Director of the Office of Management and Budget.

“classified material” applies throughout its subchapter

The terms “classified material” and “classified record” include any correspondence, memorandum, book, plan, map, drawing, diagram, pictorial or graphic work, photograph, film, microfilm, sound recording, videotape, machine readable records, and other documentary material, regardless of physical form or characteristics, that has been determined pursuant to Executive order to require protection against unauthorized disclosure in the interests of the national security of the United States. (3) Declassification

“classified record” applies throughout its subchapter

The terms “classified material” and “classified record” include any correspondence, memorandum, book, plan, map, drawing, diagram, pictorial or graphic work, photograph, film, microfilm, sound recording, videotape, machine readable records, and other documentary material, regardless of physical form or characteristics, that has been determined pursuant to Executive order to require protection against unauthorized disclosure in the interests of the national security of the United States. “declassification” applies throughout its subchapter

The term “declassification” means the process by which records or materials that have been classified are determined no longer to require protection from unauthorized disclosure to protect the national security of the United States. (4) Donated historical material

“donated historical material” applies throughout its subchapter

The term “donated historical material” means collections of personal papers donated or given to a Federal Presidential library or other archival repository under a deed of gift or otherwise. (5) Federal Presidential library

“Federal Presidential library” applies throughout its subchapter

The term “Federal Presidential library” means a library operated and maintained by the United States Government through the National Archives and Records Administration under the applicable provisions of the Federal Records Act of 1950. (6) National security

“national security” applies throughout its subchapter

The term “national security” means the national defense or foreign relations of the United States. (7) Records or materials of extraordinary public interest

“records of archival value” applies throughout its subchapter

The term “records of archival value” means records that have been determined by the Archivist of the United States to have sufficient historical or other value to warrant their continued preservation by the Federal Government.

“records or materials of extraordinary public interest” applies throughout its subchapter

The term “records or materials of extraordinary public interest” means records or materials that— (A) demonstrate and record the national security policies, actions, and decisions of the United States, including— (i) policies, events, actions, and decisions which led to significant national security outcomes; and (ii) the development and evolution of significant United States national security policies, actions, and decisions; (B) will provide a significantly different perspective in general from records and materials publicly available in other historical sources; and (C) would need to be addressed through ad hoc record searches outside any systematic declassification program established …

The term “covered institution of higher education” means an institution described in section 1002 of title 20 that receives Federal funds in any amount and for any purpose. (2) Sensitive research subject

The term “sensitive research subject” means a subject of research that is carried out at a covered institution of higher education that receives funds that were appropriated for— (A) the National Intelligence Program; or (B) any Federal agency the Director of National Intelligence deems appropriate.

(b) Establishment There is established within the executive branch an interagency committee to counter active measures by the Russian Federation, the People’s Republic of China, the Islamic Republic of Iran, the Democratic People’s Republic of Korea, or other nation state to exert covert influence.

The term “foreign commercial threat” means a rare commercial item or service that is produced by, offered by, sold by, licensed by, or otherwise distributed under the control of a strategic competitor or foreign adversary in a manner that may provide the strategic competitor or foreign adversary leverage over an intended recipient.

“rare commercial item or service” applies in that section

The term “rare commercial item or service” means a good, service, or intellectual property that is not widely available for distribution. (b) Working Group (1) Establishment Unless the Director of National Intelligence and the Secretary of Commerce make the joint determination specified in subsection (c), the Director and the Secretary, in consultation with the Secretary of State, shall jointly establish a working group to counter foreign commercial threats (in this section referred to as the “Working Group”).

“Federal election cycle” applies in that section

the term “Federal election cycle” means the period which begins on the day after the date of a regularly scheduled general election for Federal office and which ends on the date of the first regularly scheduled general election for Federal office held after such date. (b) In general The Director of National Intelligence, in coordination with the Director of the Central Intelligence Agency, the Director of the National Security Agency, the Director of the Federal Bureau of Investigation, the Secretary of Homeland Security, and the heads of other relevant elements of the intelligence community, shall— (1) commence not later than 1 year before any regularly scheduled Federal election occurring after December 31, 2018 , and complete not later than 180 days before such election, an assessment of security vulnerabilities of State election systems; and (2) not later …

The term “cyber intrusion” means an electronic occurrence that actually or imminently jeopardizes, without lawful authority, electronic election infrastructure, or the integrity, confidentiality, or availability of information within such infrastructure. (5) Electronic election infrastructure

“election” applies in that section

The terms “candidate”, “election”, and “political party” have the meanings given those terms in section 30101 of title 52 . (3) Congressional leadership

“electronic election infrastructure” applies in that section

The term “electronic election infrastructure” means an electronic information system of any of the following that is related to an election for Federal office: (A) The Federal Government. (B) A State or local government. (C) A political party. (D) The election campaign of a candidate. (6) Federal office

“Federal office” applies in that section

The term “Federal office” has the meaning given that term in section 30101 of title 52 . (7) High confidence The term “high confidence”, with respect to a determination, means that the determination is based on high-quality information from multiple sources. (8) Moderate confidence The term “moderate confidence”, with respect to a determination, means that a determination is credibly sourced and plausible but not of sufficient quality or corroborated sufficiently to warrant a higher level of confidence. (9) Other appropriate congressional committees

“other appropriate congressional committees” applies in that section

The term “other appropriate congressional committees” means— (A) the Committee on Armed Services, the Committee on Foreign Relations, the Committee on Homeland Security and Governmental Affairs, and the Committee on Appropriations of the Senate; and (B) the Committee on Armed Services, the Committee on Foreign Affairs, the Committee on Homeland Security, and the Committee on Appropriations of the House of Representatives.

The term “intelligence community” has the meaning given such term in section 3003 of this title . (6) Line organization

“line organization” applies in that section

The term “line organization” means, with respect to a department or agency of the Federal Government, an organization that executes programs and activities to directly advance the core functions and missions of the department or agency to which the organization is subordinate, but, with respect to the Department of Defense, does not include a component of the Office of the Secretary of Defense. (7) Transmedium objects or devices

“transmedium objects or devices” applies in that section

The term “transmedium objects or devices” means objects or devices that are— (A) observed to transition between space and the atmosphere, or between the atmosphere and bodies of water; and (B) not immediately identifiable. (8) Unidentified anomalous phenomena

“unidentified anomalous phenomena” applies in that section

The term “unidentified anomalous phenomena” means— (A) airborne objects that are not immediately identifiable; (B) transmedium objects or devices; and (C) submerged objects or devices that are not immediately identifiable and that display behavior or performance characteristics suggesting that the objects or devices may be related to the objects described in subparagraph (A).

“authorized disclosure” applies in that section

The term “authorized disclosure” means a report of any information through, and in compliance with, the mechanism for authorized reporting established pursuant to subsection (a)(1).;

“congressional intelligence committees” applies in that section

The term “congressional intelligence committees” has the meaning given such term in section 3003 of this title .;

“congressional leadership” applies in that section

The term “congressional leadership” means— (A) the majority leader of the Senate; (B) the minority leader of the Senate; (C) the Speaker of the House of Representatives; and (D) the minority leader of the House of Representatives.;

“intelligence community” applies in that section

The term “intelligence community” has the meaning given such term in section 3003 of this title .;

“nondisclosure agreement” applies in that section

The term “nondisclosure agreement” means any written or oral nondisclosure agreement, order, or other instrumentality or means entered into by an individual that could be interpreted as a legal constraint on the individual making an authorized disclosure.;

“Office” applies in that section

The term “Office” means the All-domain Anomaly Resolution Office established pursuant to section 3373(a) of this title .;

“personnel action” applies in that section

The term “personnel action” has the meaning given such term in section 3234(a) of this title .;

“unidentified anomalous phenomena” applies in that section

The term “unidentified anomalous phenomena” has the meaning given such term in section 3373(n) of this title .

“United States person” applies in that section

the term “United States person” has the meaning given the term in section 3039 of this title .

“congressional intelligence committees” applies in that section

the term “congressional intelligence committees” means— (A) the Select Committee on Intelligence of the Senate; and (B) the Permanent Select Committee on Intelligence of the House of Representatives. (g) Personnel (1) Personnel of the National Counterintelligence and Security Center may consist of personnel employed by the Center or personnel on detail from any other department, agency, or element of the Federal Government. Any such detail may be on a reimbursable or nonreimbursable basis, at the election of the head of the agency detailing such personnel.

“covered device” applies in that section

the term “covered device” means any electronic mobile device including smartphones, tablet computing devices, or laptop computing devices, that is issued by an element of the intelligence community for official use. (f) Additional requirements regarding National Threat Identification and Prioritization Assessment and National Counterintelligence Strategy (1) A National Threat Identification and Prioritization Assessment under subsection (e)(1), and any modification of such assessment, shall not go into effect until approved by the President.

“Department” applies in that section

The term “Department” means the Department of Agriculture. (2) Secretary

“Secretary” applies in that section

The term “Secretary” means the Secretary of Agriculture. (b) Omitted (c) Establishment of Intelligence Community Counterintelligence Office (1) Agreement with Secretary of Agriculture The Director of National Intelligence, acting through the Director of the National Counterintelligence and Security Center, shall seek to enter into an agreement with the Secretary under which the Director of National Intelligence and the Secretary shall establish within the Department an office, which shall be known as the “Intelligence Community Counterintelligence Office”, in accordance with this section.

“Agency head” applies in that section

the term “Agency head” shall mean the Director, the Deputy Director, or the Executive of the Agency. (c) Classes of purchases and contracts; finality of decision; powers delegable The determinations and decisions provided in subsection (a) of this section to be made by the Agency head may be made with respect to individual purchases and contracts or with respect to classes of purchases or contracts, and shall be final.

“fundraising” applies in that section

the term “fundraising” means the raising of funds through the active participation in the promotion, production, or presentation of an event designed to raise funds and does not include the direct solicitation of money by any other means. (3) Not later than the date that is 7 days after the date the Director engages in fundraising authorized by this subsection or at the time the decision is made to participate in such fundraising, the Director shall notify the Select Committee on Intelligence of the Senate and the Permanent Select Committee on Intelligence of the House of Representatives of the fundraising.

“gift” applies in that section

the term “gift” includes a bequest or devise. (f) Fundraising (1) The Director may engage in fundraising in an official capacity for the benefit of nonprofit organizations that provide support to surviving family members of deceased Agency employees or that otherwise provide support for the welfare, education, or recreation of Agency employees, former Agency employees, or their family members. (2) In this subsection,

“crime of violence” applies in that section

The term “unmanned aircraft system” has the meaning given the term in section 44801 of title 49 .

“wire communication” applies in that section

The terms “electronic communication”, “intercept”, “oral communication”, and “wire communication” have the meanings given those terms in section 2510 of title 18 . (5) United States

“health benefits plan” applies in that section

the term “health benefits plan” means an approved health benefits plan under chapter 89 of title 5.

“covered provision” applies in that section

the term “covered provision” means— (I) any otherwise applicable nondisclosure agreement; (II) any otherwise applicable regulation or order issued under the authority of chapter 18 of the Atomic Energy Act of 1954 ( 42 U.S.C. 2271 et seq.) or Executive Order 13526; (III) section 798 of title 18 ; or (IV) any other provision of law with respect to the unauthorized disclosure of national security information.

“employee” applies in that section

The term “employee” includes a former employee or former contractor, if the complaint or information reported under subparagraph (A) arises from or relates to the period during which the former employee or former contractor was an employee or contractor, as the case may be. (ii) Within the executive branch, the Inspector General shall have sole authority to determine whether any complaint or information reported to the Inspector General is a matter of urgent concern under this paragraph.

(f) Separate budget account (1) Beginning with fiscal year 1991, and in accordance with procedures to be issued by the Director of National Intelligence in consultation with the intelligence committees, the Director of National Intelligence shall include in the National Intelligence Program budget a separate account for the Office of Inspector General established pursuant to this section.

“urgent concern” applies in that section

The term “urgent concern” means any of the following: (aa) A serious or flagrant problem, abuse, violation of law or Executive order, or deficiency relating to the funding, administration, or operations of an intelligence activity of the Federal Government that is— (AA) a matter of national security; and (BB) not a difference of opinion concerning public policy matters. (bb) A false statement to Congress, or a willful withholding from Congress, on an issue of material fact relating to the funding, administration, or operation of an intelligence activity.

“total service” applies in that section

the term “total service” has the meaning given such term under chapter 83 of title 5. (c) Annuities deemed annuities under section 8339 of title 5 For purposes of subsections (f) through (m) of section 8339 of title 5 , an annuity computed under this section shall be deemed to be an annuity computed under subsections (a) and ( o ) 1 of section 8339 of title 5 .

“Director” applies in that section

the term “Director” means the Director of the Central Intelligence Agency; and;

“employee” applies in that section

the term “employee” means an employee of the Central Intelligence Agency, serving under an appointment without time limitation, who has been currently employed for a continuous period of at least 12 months, except that such term does not include— (A) a reemployed annuitant under subchapter III of chapter 83 or chapter 84 of title 5 or another retirement system for employees of the Government; or (B) an employee having a disability on the basis of which such employee is or would be eligible for disability retirement under any of the retirement systems referred to in subparagraph (A).

“covered dependent” applies in that section

The term “covered dependent” means a family member (as defined by the Director) of a covered employee who, on or after September 11, 2001 — (A) accompanies the covered employee to an assigned duty station in a foreign country; and (B) becomes injured by reason of a qualifying injury. (2) Covered employee

“covered employee” applies in that section

The term “covered employee” means an officer or employee of the Central Intelligence Agency who, on or after September 11, 2001 , becomes injured by reason of a qualifying injury. (3) Covered individual

“covered individual” applies in that section

The term “covered individual” means an individual who— (A) (i) is detailed to the Central Intelligence Agency from other agencies of the United States Government or from the Armed Forces; or (ii) is affiliated with the Central Intelligence Agency, as determined by the Director; and (B) who, on or after September 11, 2001 , becomes injured by reason of a qualifying injury. (4) Qualifying injury

“qualifying injury” applies in that section

The term “qualifying injury” means the following: (A) With respect to a covered dependent, an injury incurred— (i) during a period in which the covered dependent is accompanying the covered employee to an assigned duty station in a foreign country; (ii) in connection with war, insurgency, hostile act, terrorist activity, or an incident designated for purposes of this section by the Director; and (iii) that was not the result of the willful misconduct of the covered dependent.

“designated employee” applies in that section

the term “designated employee” means an employee designated by the Director of the Central Intelligence Agency under subsection (b); and;

“Federal retirement system” applies in that section

the term “Federal retirement system” includes the Central Intelligence Agency Retirement and Disability System, and the Federal Employees’ Retirement System (including the Thrift Savings Plan). (b) In general (1) Authority Notwithstanding any other provision of law, the Director of the Central Intelligence Agency may exercise the authorities under this section in order to— (A) protect from unauthorized disclosure— (i) intelligence operations; (ii) the identities of undercover intelligence officers; (iii) intelligence sources and methods; or (iv) intelligence cover mechanisms; or (B) meet the special requirements of work related to collection of foreign intelligence or other authorized …

“intelligence committees” applies in that section

the term “intelligence committees” means the Permanent Select Committee on Intelligence of the House of Representatives and the Select Committee on Intelligence of the Senate.

“educational institution” applies in that section

The term “educational institution” includes any public or private elementary school or secondary school, institution of higher education, college, university, or any other profit or nonprofit institution that is dedicated to improving science, technology, engineering, the arts, mathematics, business, law, medicine, or other fields that promote development and education relating to science, technology, engineering, the arts, or mathematics. (3) State

“eligible entity” applies in that section

The term “eligible entity” includes a department or agency of the Federal Government, a State, a political subdivision of a State, an individual, and a not-for-profit or other organization in the private sector. (2) Educational institution

“State” applies in that section

The term “State” means each of the several States, the District of Columbia, the Commonwealth of Puerto Rico, the Commonwealth of the Northern Mariana Islands, and any other territory or possession of the United States. (b) Requirements The Director shall, on a continuing basis— (1) identify actions that the Director may take to improve education in the scientific, technology, engineering, arts, and mathematics (known as “STEAM”) skills necessary to meet the long-term national security needs of the United States for personnel proficient in such skills; and (2) establish and conduct programs to carry out such actions.

“appropriate congressional committees” applies in that section

the term “appropriate congressional committees” means— (A) the Select Committee on Intelligence and the Subcommittee on Defense of the Committee on Appropriations of the Senate; and (B) the Permanent Select Committee on Intelligence and the Subcommittee on Defense of the Committee on Appropriations of the House of Representatives.

“report” applies in that section

The term “report” means a communication— (A) by a victim; (B) that describes information relating to an allegation of sexual assault or sexual harassment; (C) to an individual eligible to document an unrestricted or restricted report; and (D) that the victim intends to result in formal documentation of an unrestricted or restricted report. (2) Victim

“victim” applies in that section

The term “victim” means a person who alleges they have suffered direct physical or emotional harm because they were subjected to sexual assault or sexual harassment.

“crime of violence” applies in that section

the term “crime of violence” has the meaning given that term in section 16 of title 18 .

“congressional intelligence committees” applies in that section

The term “congressional intelligence committees” has the meaning given that term in section 3003 of this title . (2) Covered intelligence collection or sharing adjustment

“covered intelligence collection or sharing adjustment” applies in that section

The term “covered intelligence collection or sharing adjustment” means an action or inaction by the National Security Agency that results in a significant change to— (A) the quantity of intelligence collected by the National Security Agency with respect to a foreign country, foreign organization, or senior leader of a foreign country or foreign organization; or (B) policies or practices of the National Security Agency with respect to the sharing of intelligence with a foreign country, organization of foreign countries, or organization of countries of which the United States is a member.

“congressional defense committees” applies throughout its chapter

The term “congressional defense committees” has the meaning given that term in section 101(a)(16) of title 10 .;

“Cooperative Threat Reduction funds” applies throughout its chapter

The term “Cooperative Threat Reduction funds” means funds appropriated pursuant to an authorization of appropriations for the Program, or otherwise made available to the Program.;

“Program” applies throughout its chapter

The term “Program” means the Cooperative Threat Reduction Program of the Department of Defense established under section 3711 of this title .

“covered activity” applies in that section

the term “covered activity” means an activity under the Program to address a threat arising from the proliferation of chemical, nuclear, or biological weapons or weapons-related materials, technologies, or expertise.

“appropriate congressional committees” applies in that section

the term “appropriate congressional committees” means the following: (1) The congressional defense committees. (2) The Committee on Foreign Affairs of the House of Representatives and the Committee on Foreign Relations of the Senate.

“new construction project” applies in that section

The term “new construction project” means a construction project for which no funds have been obligated or expended as of November 24, 2003 .;

“permit” applies in that section

The term “permit” means any local or national permit for development, general construction, environmental, land use, or other purposes that is required for purposes of major construction.

“brother” applies in that section

the term “brother” or “sister” means a brother of the whole blood or a sister of the whole blood, as the case may be.

“sister” applies in that section

the term “brother” or “sister” means a brother of the whole blood or a sister of the whole blood, as the case may be.

“duly ordained minister of religion” applies throughout its chapter

The term “duly ordained minister of religion” means a person who has been ordained, in accordance with the ceremonial, ritual, or discipline of a church, religious sect, or organization established on the basis of a community of faith and belief, doctrines and practices of a religious character, to preach and to teach the doctrines of such church, sect, or organization and to administer the rites and ceremonies thereof in public worship, and who as his regular and customary vocation preaches and teaches the principles of religion and administers the ordinances of public worship as embodied in the creed or principles of such church, sect, or organization.;

“regular minister of religion” applies throughout its chapter

The term “regular minister of religion” means one who as his customary vocation preaches and teaches the principles of religion of a church, a religious sect, or organization of which he is a member, without having been formally ordained as a minister of religion, and who is recognized by such church, sect, or organization as a regular minister.

“Government agency” applies in that section

The term “Government agency” means any department, agency, independent establishment, or corporation in the Executive branch of the United States Government. (2) For the purposes of this section, a plant, mine, or other facility shall be deemed capable of producing any articles or materials if it is then producing or furnishing such articles or materials or if the President after consultation with and receiving advice from the National Security Resources Board determines that it can be readily converted to the production or furnishing of such articles or materials.

“person” applies in that section

The term “person” means any individual, firm, company, association, corporation, or other form of business organization.;

“court” applies throughout its chapter

The term “court” means a court or an administrative agency of the United States or of any State (including any political subdivision of a State), whether or not a court or administrative agency of record. (6) State

“judgment” applies throughout its chapter

The term “judgment” means any judgment, decree, order, or ruling, final or temporary.

“military service” applies throughout its chapter

The term “military service” means— (A) in the case of a servicemember who is a member of the Army, Navy, Air Force, Marine Corps, Space Force, or Coast Guard— (i) active duty, as defined in section 101(d)(1) of title 10 , and (ii) in the case of a member of the National Guard, includes service under a call to active service authorized by the President or the Secretary of Defense for a period of more than 30 consecutive days under section 502(f) of title 32 for purposes of responding to a national emergency declared by the President and supported by Federal funds; (B) in the case of a servicemember who is a commissioned officer of the Public Health Service or the National Oceanic and …

“motor vehicle” applies throughout its chapter

The term “motor vehicle” has the meaning given that term in section 30102(a)(6) of title 49 . 1 (9) Judgment

“period of military service” applies throughout its chapter

The term “period of military service” means the period beginning on the date on which a servicemember enters military service and ending on the date on which the servicemember is released from military service or dies while in military service. (4) Dependent The term “dependent”, with respect to a servicemember, means— (A) the servicemember’s spouse; (B) the servicemember’s child (as defined in section 101(4) of title 38 ); or (C) an individual for whom the servicemember provided more than one-half of the individual’s support for 180 days immediately preceding an application for relief under this chapter. (5) Court

“Secretary concerned” applies throughout its chapter

The term “Secretary concerned”— (A) with respect to a member of the armed forces, has the meaning given that term in section 101(a)(9) of title 10 ; (B) with respect to a commissioned officer of the Public Health Service, means the Secretary of Health and Human Services; and (C) with respect to a commissioned officer of the National Oceanic and Atmospheric Administration, means the Secretary of Commerce. (8) Motor vehicle

“servicemember” applies throughout its chapter

The term “servicemember” means a member of the uniformed services, as that term is defined in section 101(a)(5) of title 10 . (2) Military service

“State” applies throughout its chapter

The term “State” includes— (A) a commonwealth, territory, or possession of the United States; and (B) the District of Columbia. (7) Secretary concerned

“interest” applies in that section

The term “interest” includes service charges, renewal charges, fees, or any other charges (except bona fide insurance) with respect to an obligation or liability. (2) Obligation or liability

“obligation or liability” applies in that section

The term “obligation or liability” includes an obligation or liability consisting of a mortgage, trust deed, or other security in the nature of a mortgage. (e) Penalty Whoever knowingly violates subsection (a) shall be fined as provided in title 18, imprisoned for not more than one year, or both.

“deployment” applies in that section

the term “deployment” means the movement or mobilization of a servicemember to a location for a period of longer than 60 days and not longer than 540 days pursuant to temporary or permanent official orders— (1) that are designated as unaccompanied; (2) for which dependent travel is not authorized; or (3) that otherwise do not permit the movement of family members to that location.

“CPI housing component” applies in that section

The term “CPI housing component” means the index published by the Bureau of Labor Statistics of the Department of Labor known as the Consumer Price Index, All Urban Consumers, Rent of Primary Residence, U.S. City Average. (3) Publication of housing price inflation adjustment The Secretary of Defense shall cause to be published in the Federal Register each year the amount in effect under paragraph (1)(A)(ii) for that year following the housing price inflation adjustment for that year pursuant to paragraph (2). Such publication shall be made for a year not later than 60 days after such adjustment is made for that year.

“catastrophic injury or illness” applies in that section

The term “catastrophic injury or illness” has the meaning given that term in section 439(g) of title 37 .;

“continental United States” applies in that section

The term “continental United States” means the 48 contiguous States and the District of Columbia. (3) Permanent change of station

“covered service” applies in that section

The term “covered service” means full-time National Guard duty, active Guard and Reserve duty, or inactive-duty training (as such terms are defined in section 101(d) of title 10 ). (b) Covered leases This section applies to the following leases: (1) Leases of premises A lease of premises occupied, or intended to be occupied, by a servicemember or a servicemember’s dependents for a residential, professional, business, agricultural, or similar purpose if— (A) the lease is executed by or on behalf of a person who thereafter and during the term of the lease enters military service; (B) the servicemember, while in military service, executes the lease and thereafter receives military orders for a …

“permanent change of station” applies in that section

The term “permanent change of station” includes separation or retirement from military service.

“commercial mobile service” applies in that section

The term “commercial mobile service” has the meaning given that term in section 332(d) of title 47 .;

“military orders” applies in that section

The terms “military orders” and “permanent change of station” have the meanings given such terms in section 3955 of this title .;

“multichannel video programming service” applies in that section

The term “multichannel video programming service” means a subscription video service offered by a multichannel video programming distributor, as that term is defined in section 522 of title 47 , over a system the distributor owns or controls.;

“permanent change of station” applies in that section

The terms “military orders” and “permanent change of station” have the meanings given such terms in section 3955 of this title .;

“provider-owned consumer premises equipment” applies in that section

The term “provider-owned consumer premises equipment” means any equipment that a provider of internet access service or multichannel video programming service rents or loans to a customer during the provision of that service, including gateways, routers, cable modems, voice-capable modems, CableCARDs, converters, digital adapters, remote controls, and any other equipment provided.;

“telephone exchange service” applies in that section

The term “telephone exchange service” has the meaning given that term under section 153 of title 47 .

“lien” applies in that section

the term “lien” includes a lien for storage, repair, or cleaning of the property or effects of a servicemember or a lien on such property or effects for any other reason. (b) Stay of proceedings In a proceeding to foreclose or enforce a lien subject to this section, the court may on its own motion, and shall if requested by a servicemember whose ability to comply with the obligation resulting in the proceeding is materially affected by military service— (1) stay the proceeding for a period of time as justice and equity require; or (2) adjust the obligation to preserve the interests of all parties. The provisions of this subsection do not affect the scope of section 3953 of this title .

“insured” applies throughout its subchapter

The term “insured” means a servicemember whose life is insured under a policy. (4) Insurer

“insurer” applies throughout its subchapter

The term “insurer” includes any firm, corporation, partnership, association, or business that is chartered or authorized to provide insurance and issue contracts or policies by the laws of a State or the United States.

“policy” applies throughout its subchapter

The term “policy” means any individual contract for whole, endowment, universal, or term life insurance (other than group term life insurance coverage), including any benefit in the nature of such insurance arising out of membership in any fraternal or beneficial association which— (A) provides that the insurer may not— (i) decrease the amount of coverage or require the payment of an additional amount as premiums if the insured engages in military service (except increases in premiums in individual term insurance based upon age); or (ii) limit or restrict coverage for any activity required by military service; and (B) is in force not less than 180 days before the date of the insured’s entry …
