52 U.S.C. § 21102 — Process for adoption

The Commission must follow four steps to adopt voluntary guidance: publish a proposal, take public comments, hold a hearing, then publish the final version. Each step must appear in the Federal Register.
The adoption of the voluntary guidance under this part shall be carried out by the Commission in a manner that provides for each of the following:
Publication of notice of the proposed recommendations in the Federal Register.
An opportunity for public comment on the proposed recommendations.
An opportunity for a public hearing on the record.
Publication of the final recommendations in the Federal Register.
