54 U.S.C. § 100721 — Definitions

This law defines three terms used in this part of the law: 'damages,' 'response costs,' and 'System unit resource.' Damages cover the cost to fix or replace harmed park resources, or their value if they can't be fixed. A 'System unit resource' is anything living or non-living inside a park's boundaries, but not something owned by a non-federal party.
(1) Damages. The term "damages" includes:
(A) compensation for either (i)(I) the cost to replace, restore, or acquire something equivalent to a harmed System unit* resource, and (II) the value of any significant loss of use of that resource while it is being restored, replaced, or an equivalent is being acquired; or (ii), if the resource cannot be replaced or restored, the resource's value instead; and
(B) the cost of doing a damage assessment under section 100723(b) of this title.
(2) Response costs. The term "response costs" means the costs of actions the Secretary* takes to:
(A) prevent or lessen the destruction, loss, or injury of a System* unit resource;
(B) reduce or minimize an imminent risk of that destruction, loss, or injury; or
(C) monitor the ongoing effects of incidents that caused the destruction, loss, or injury.
(3) System unit resource.
(A) In general. The term "System unit resource" means any living or non-living resource located within a System unit's boundaries.
(B) Exclusion. The term does not include a resource owned by a non-federal entity.
In this subchapter:
The term “damages” includes—
compensation for—
the cost of replacing, restoring, or acquiring the equivalent of a System unit* resource; and
the value of any significant loss of use of a System* unit resource pending its restoration or replacement or the acquisition of an equivalent resource; or
the value of the System unit resource if the System unit resource cannot be replaced or restored; and
the cost of a damage assessment under section 100723(b) of this title.
The term “response costs” means the costs of actions taken by the Secretary* to—
prevent or minimize destruction or loss of or injury to a System unit resource;
abate or minimize the imminent risk of the destruction, loss, or injury; or
monitor ongoing effects of incidents causing the destruction, loss, or injury.
The term “System unit resource” means any living or non-living resource that is located within the boundaries of a System unit.
The term “System unit resource” does not include a resource owned by a non-Federal entity.
