If more than one business gets a contract to offer the same kind of service, like river guiding, at the same spot in a park, the Secretary must charge them comparable franchise fees. Awarding a new contract doesn't let the Secretary reopen an existing concessioner's contract terms.
When the Secretary* awards multiple concession contracts authorizing similar services — like outfitting, guiding, or river running — at roughly the same location or resource within a System unit*, the Secretary must set up a comparable franchise fee structure across those contracts. However, awarding a new contract at that same location or resource does not let the Secretary modify or renegotiate the terms of any existing concession contract already in place there.
If multiple concession contracts are awarded to authorize concessioners to provide the same or similar outfitting, guiding, river running, or other similar services at the same approximate location or resource within a System unit*, the Secretary* shall establish a comparable franchise fee structure for those contracts or similar contracts, except that the terms and conditions of any existing concession contract shall not be subject to modification or open to renegotiation by the Secretary because of an award of a new contract at the same approximate location or resource.
