This section defines "undertaking" as a project, activity, or program funded or controlled by a Federal agency. That includes projects the agency runs itself, projects it funds, projects needing a Federal permit or license, and projects under State or local rules the Federal government approved.
This section defines "undertaking" for this division. An undertaking is a project, activity, or program that a Federal agency* funds, in whole or in part, or that falls under a Federal agency's direct or indirect control. This includes four kinds: (1) projects a Federal agency carries out itself or has someone carry out on its behalf; (2) projects that get Federal financial assistance; (3) projects that need a Federal permit, license, or approval; and (4) projects that State* or local governments regulate under authority the Federal government delegated or approved.
In this division, the term “undertaking” means a project, activity, or program funded in whole or in part under the direct or indirect jurisdiction of a Federal agency*, including—
those carried out by or on behalf of the Federal agency;
those carried out with Federal financial assistance;
those requiring a Federal permit, license, or approval; and
those subject to State* or local regulation administered pursuant to a delegation or approval by a Federal agency.
