54 U.S.C. § 309101 — Sites and structures that commemorate former Presidents

(a) Survey. The Secretary^* may survey sites that the Secretary considers to have qualities most suitable for commemorating each former President. The survey may (1) include sites connected with a former President’s deeds, leadership, or lifework, and (2) identify sites or structures that are not historically connected with a former President but may be suitable as a memorial to honor that President.nn(b) Reports. From time to time, the Secretary must prepare and send the House Committee on Natural Resources and the Senate Committee on Energy and Natural Resources reports about individual sites and structures identified in a survey under subsection (a). The reports must include the Secretary’s recommendation about whether each site or structure is suitable to be established as a national historic site or national memorial to commemorate a former President. Each report must include relevant information about the need to acquire land and interests in land, develop facilities, and operate and maintain the site or structure, along with the estimated cost of operating and maintaining it.nn(c) Establishment as National Historic Site. During the six months after a report is sent under subsection (b), if neither committee votes by a majority of its members to disapprove the Secretary’s recommendation that a site or structure is suitable to be established as a national historic site, the Secretary may establish the site or structure as a national historic site by an appropriate order. The order may include the land and interests in land identified in the report that accompanied the Secretary’s recommendation.nn(d) Acquisition of Land and Interests in Land. The Secretary may acquire the land and interests in land by donation, purchase with donated or appropriated money, transfer from any other Federal agency, or exchange.nn(e) Effect of Section. Nothing in this section may be interpreted as reducing the Secretary’s authority under chapter 3201 of this title or as authorizing the Secretary to establish a national memorial whose creation is expressly reserved to Congress.
