6 U.S.C. § 123 — Terrorist travel program

This section required DHS to create a terrorist travel program. (a) Requirement to establish. Within 90 days of August 3, 2007, the Secretary of Homeland Security — working with the Director of the National Counterterrorism Center and consistent with a strategy developed under section 7201 — had to establish a program overseeing the Secretary's responsibilities for terrorist travel. (b) Head of the program. The Secretary must designate an official to run the program — either the Assistant Secretary for Policy of DHS, or another official appointed by the Secretary who reports directly to the Secretary. (c) Duties. That designated official must help the Secretary improve DHS's ability to keep terrorists from entering or staying undetected in the U.S., by: (1) developing relevant strategies and policies; (2) reviewing existing programs and recommending improvements; (3) making budget, funding, and staffing recommendations; (4) coordinating policy, programs, planning, operations, and intelligence-sharing on terrorist travel among DHS components — including Customs and Border Protection, Immigration and Customs Enforcement, Citizenship and Immigration Services, the Transportation Security Administration, and the Coast Guard — as well as between DHS and other federal agencies; and (5) serving as the Secretary's main point of contact with the National Counterterrorism Center, making sure the Center's terrorist-travel recommendations get carried out by DHS. (d) Report. Within 180 days of August 3, 2007, the Secretary had to report to the Senate Homeland Security and Governmental Affairs Committee and the House Homeland Security Committee on how this section was being implemented.
