This law requires certain Department agencies to grade employees on counternarcotics work. It applies to National Drug Control Program agencies and their employees. Reviews should measure things like drug seizures, arrests, and cooperation with other agencies.

(a) In general: Every subdivision of the Department that is a "National Drug Control Program Agency" must include, as one criterion in its performance appraisal system, how well each employee involved — directly or indirectly — in enforcing federal, state, or local narcotics laws performs that enforcement work. Reviewers should rely as much as practical on objective measures, including (1) the employee's contribution to drug seizures and arrests of narcotics-law violators, and (2) how much the employee cooperated with or contributed to other employees' counternarcotics efforts, whether inside the Department or at other federal, state, or local agencies.

(b) Definitions: For this section, (1) "National Drug Control Program Agency" means (A) an agency defined that way under 21 U.S.C. § 1701(7), as it last applied, and (B) any subdivision of the Department that has significant counternarcotics responsibility, as determined by (i) the counternarcotics officer appointed under section 458 of this title, or (ii) if applicable, whoever the Secretary determines succeeds that officer's function; and (2) "performance appraisal system" means any system for periodically appraising employees' job performance, whether under 5 U.S.C. chapter 43 or otherwise.
