6 U.S.C. § 441 — Administration

(a) In general. The Secretary is responsible for administering this part of the law — the system that protects sellers of qualified anti-terrorism technologies. (b) Designation of qualified anti-terrorism technologies. The Secretary may designate specific anti-terrorism technologies as "qualified," meaning they get protection under this part's system of risk management. The criteria the Secretary must consider include, but aren't limited to: (1) whether the U.S. government has used the technology before, or whether it has shown substantial usefulness and effectiveness; (2) whether the technology is available for immediate use in public and private settings; (3) whether the seller or provider of the technology faces extraordinarily large, or extraordinarily hard-to-measure, potential liability risk from third parties; (4) whether it's substantially likely that the technology won't be deployed at all unless it gets this part's protections; (5) how much risk the public faces if the technology is not deployed; (6) a review of all feasible scientific studies assessing whether the technology can substantially reduce risks of harm; and (7) whether the technology would be effective at helping to defend against acts of terrorism, including technologies that prevent, defeat, or respond to such acts. (c) Regulations. The Secretary may issue regulations needed to carry out this part, but only after going through the notice-and-comment process required by section 553 of title 5.
