This section establishes the State Homeland Security Grant Program. It sets application, distribution, multistate, minimum-allocation, and funding rules for grants to help governments prevent, prepare for, protect against, and respond to terrorism.

(a) Establishment. The State Homeland Security Grant Program is established to help State, local, and tribal governments prevent, prepare for, protect against, and respond to acts of terrorism.

(b) Application. (1) Each State may apply for a grant and must provide information the Administrator reasonably requires. (2) At a minimum, the application must state: (A) the purpose of the funds and why the State needs them to meet its target capabilities; (B) how the State plans to allocate funds to local governments and Indian tribes; and (C) a budget showing how the State plans to spend the funds. (3) Applicants must apply or reapply every year.

(c) Distribution to local and tribal governments. (1) Within 45 days after receiving grant funds, a State must make available to local and tribal governments, consistently with the applicable State homeland security plan, either (A) at least 80 percent of the grant funds; (B) with their consent, items, services, or activities worth at least 80 percent of the grant; or (C) with their consent, grant funds combined with other items, services, or activities worth at least 80 percent of the grant. (2) The State must certify to the Administrator that it made this distribution. (3) The Governor may ask in writing for more time. The Administrator may approve the request if the delay is necessary for effective investments against terrorism. (4) Paragraph (1) does not apply to the District of Columbia, Puerto Rico, American Samoa, the Northern Mariana Islands, Guam, or the Virgin Islands. (5) If a State does not distribute the funds on time, an eligible local or tribal government may petition the Administrator to provide the funds directly.

(d) Multistate applications. (1) Two or more States may apply together, instead of or in addition to an application under subsection (b), for multistate terrorism-prevention efforts. (2) They must submit a plan stating (A) how grant-administration duties will be divided and (B) how funding will be divided among the participating States.

(e) Minimum allocation. (1) When distributing funds, the Administrator must ensure that, except for subparagraph (B), each State receives at least: (A)(i) 0.375 percent of the total funds appropriated for grants under this section and section 604 in fiscal year 2008; (ii) 0.365 percent in 2009; (iii) 0.36 percent in 2010; (iv) 0.355 percent in 2011; and (v) 0.35 percent in 2012 and every later fiscal year. (B) In every fiscal year, American Samoa, the Northern Mariana Islands, Guam, and the Virgin Islands each receive at least 0.08 percent of those total appropriations. (2) A State’s share of a multistate award counts toward its minimum allocation.

(f) Appropriations. Congress may appropriate $950,000,000 for grants under this section for each fiscal year 2008 through 2012, and whatever sums are necessary for fiscal year 2013 and each later fiscal year.
