The Secretary of Agriculture sends test samples to laboratories seeking accreditation. Labs must analyze them and report the results. Accredited labs get tested at least twice a year to keep their accreditation.
(a) Performance evaluation samples.
(1) The Secretary* must make sure that performance evaluation samples are sent to any laboratory* that has applied for accreditation.
(2) The laboratory must analyze those samples and send the results to the Secretary, following the process set out in section 138a of this title.
(3) The laboratory must test the samples using methods specifically approved for that purpose, or alternate methods proven to work just as well, as spelled out in regulations under this chapter.
(b) Results of testing.
(1) The laboratory must submit its test results to the Secretary, on forms the Secretary provides, by whatever date the Secretary sets.
(2) The Secretary must evaluate those results and decide whether the laboratory is capable of accurately analyzing chemical residues in agricultural products.
(c) Review of accreditation. The Secretary must make sure that laboratories already accredited under this chapter receive new performance evaluation samples to analyze at least twice a year.
The Secretary shall ensure that performance evaluation samples are provided to any laboratory* that has applied for accreditation under this chapter.
A laboratory described in paragraph (1) shall analyze such performance evaluation samples and submit the results of such analysis to the Secretary, as provided for in section 138a of this title.
Samples shall be tested by the laboratory according to methods specifically approved for such purpose by alternate methods of demonstrated adequacy or equivalence, as determined in regulations established under this chapter.
The laboratory shall submit the results of the tests conducted under subsection (a) to the Secretary on forms provided by the Secretary, on or before the date determined by the Secretary.
The Secretary shall evaluate the results of such tests achieved by the laboratory and shall determine whether such laboratory is capable of undertaking an accurate analysis of chemical residues in agricultural products.
The Secretary shall ensure that performance evaluation samples for analysis are provided to laboratories accredited under this chapter not less than two times a year.
