submitted 105 years ago by ch. 64 to r/title-7-AGRICULTURE · 186 words · no verdicts yet

in plain englishAI-generated · not legal advice

Anyone who disobeys the Secretary's cease-and-desist order faces criminal punishment. This applies once appeal deadlines pass or courts uphold the order. The fine runs $500 to $10,000, plus up to five years in prison, or both.

A packer or swine contractor — or any of their officers, directors, agents, or employees — who disobeys an order from the Secretary issued under section 193 (or that order as modified) can be prosecuted, once one of these is true: (1) the deadline for filing an appeal to a court of appeals has passed without a petition being filed; (2) the deadline for asking the Supreme Court for review has passed, after a court of appeals upheld the order, without anyone applying for that review; or (3) the courts have already upheld the order (or the modified order) as described in section 194. Once convicted, the punishment is a fine of $500 to $10,000, or six months to five years in prison, or both. Each day the violation continues counts as a separate offense.
