7 U.S.C. § 2423 — Joint breeders

When two or more people bred a plant variety, one breeder or that breeder’s successor may apply while naming the others. The Secretary may issue protection to the applicant and other breeders who later join the application.
(a) If two or more people are the breeders, one of them, or that person’s successor, may apply and name the other breeders.
(b) After giving the notice required by the Secretary, the Secretary may issue a plant-variety-protection certificate to the applicant and to any other breeders, or their successors in interest, who later join the application.
When two or more persons are the breeders, one person (or the successor of the person) may apply, naming the others.
The Secretary, after such notice as the Secretary may prescribe, may issue a certificate of plant variety protection to the applicant and such of the other breeders (or their successors in interest) as may have subsequently joined in the application.
