The Secretary must examine a plant-variety-protection application. If the applicant qualifies under the law, the Secretary must issue a notice allowing protection.
The Secretary must arrange for the application to be examined. If the examination shows that the applicant is legally entitled to plant-variety protection, the Secretary must issue a notice allowing that protection as provided later in the law.
The Secretary shall cause an examination to be made of the application and if on such examination it is determined that the applicant is entitled to plant variety protection under the law, the Secretary shall issue a notice of allowance of plant variety protection therefor as hereinafter provided.
