This section establishes criminal penalties for certain willful violations. It also establishes penalties for failing to obey certain orders of the Secretary.

(a) Whoever willfully violates any provision of this chapter or the regulations of the Secretary issued “hereunder” (this section does not define “hereunder”) is guilty of a misdemeanor and must be fined not more than $10,000, imprisoned for not more than one year, or both. (b) A person who fails to obey an order of the Secretary issued under section 3804 of this title, or that order as modified, must, upon conviction, be fined not more than $10,000, imprisoned for not more than one year, or both— (1) after the time allowed for filing a petition in the court of appeals to review the order has expired, if no petition was filed within that time; (2) after the time allowed for applying for a writ of certiorari has expired, if the court of appeals upheld the order or the modified order and no such writ was applied for within that time; or (3) after the order or modified order was upheld by the courts as provided in section 3804(b) of this title. Each day that the failure continues is a separate offense.
