7 U.S.C. § 4913 — Suspension or termination of plans

(a) Whenever the Secretary^* finds that a plan^* or one of its provisions obstructs, or does not tend to carry out, this chapter’s declared policy, the Secretary must end or suspend the plan or provision.

(b) The Secretary may hold a referendum at any time. The Secretary must hold one if the Board^* requests it or if at least 10 percent of the combined number of watermelon^* producers, handlers, and importers eligible to vote in a referendum request it. The referendum determines whether watermelon producers, handlers, and importers favor ending or suspending the plan. At the end of the marketing year, the Secretary must end or suspend the plan when both of these conditions are met: (1) the Secretary determines that a majority of the people voting in the referendum favor ending or suspending the plan; and (2) those voting who produce, handle, or import watermelons account for more than 50 percent of the combined total volume of watermelons produced by the voting producers, handled by the voting handlers, or imported by the voting importers.
