7 U.S.C. § 7512 — Regulations

(a) Issuance The Secretary must issue regulations to carry out this chapter within 30 days. (b) Minimization of regulatory requirements While running this chapter, the Secretary must keep the regulatory, recordkeeping, and paperwork burdens placed on eligible recipient agencies as low as practically possible. (c) Publication in Federal Register (1) As early as feasible, but no later than the start of each fiscal year, the Secretary must publish in the Federal Register an estimate of the types and amounts of commodities the Secretary expects to make available under the commodity distribution program that year. (2) The actual types and amounts of commodities the Secretary provides may end up different from that estimate. (d) Standards of liability for commodity losses The Secretary's regulations must set standards for who is liable for lost commodities under this program in cases where there's no evidence of negligence or fraud, and must set the conditions for paying to cover those losses. These standards must take into account the special needs and circumstances of emergency feeding organizations. (e) Final regulations The Secretary may issue final regulations to carry out sections 7514 and 7515 without first proposing them for public comment. But if the Secretary skips that public-comment step, the Secretary must still let the public comment on the final regulations afterward, consider those comments, and make appropriate changes no later than 1 year after September 19, 1988. Any such final or later-modified regulations must come with a written statement explaining their basis and purpose.
