7 U.S.C. § 7999 — Availability of incentive payments for certain producers

This section provides up to $20 million in incentive payments for hard white wheat during the 2003–2005 crop years. Payments are limited to qualifying production and require proof of available buyers and end users.
(a) Subject to subsection (b), during the 2003–2005 crop years the Secretary* must make $20,000,000 total from Commodity Credit Corporation funds available for incentive payments to hard-white-wheat producers. (b) The Secretary may implement this only for production meeting minimum quality standards and covering no more than 2,000,000 acres or the equivalent production volume. (c) A producer* must show, to the Secretary's satisfaction, that buyers and end users are available for the wheat covered by the payment.
Subject to subsection (b), the Secretary* shall make available a total of $20,000,000 of funds of the Commodity Credit Corporation during the 2003 through 2005 crop years to provide incentive payments to producers of hard white wheat.
The Secretary shall implement subsection (a)—
only with regard to production that meets minimum quality criteria; and
on not more than 2,000,000 acres or the equivalent volume of production.
To be eligible to obtain an incentive payment under subsection (a), a producer* shall demonstrate to the satisfaction of the Secretary that buyers and end-users are available for the wheat to be covered by the incentive payment.
