This section preserves State authority to regulate telephone service that the Federal Communications Commission does not regulate. This includes the authority to regulate rates under applicable State law.
Nothing in this chapter may be interpreted to take away any State commission’s, board’s, or other agency’s authority under State law, now or later in effect, to regulate telephone service that the Federal Communications Commission does not regulate under the Communications Act of 1934, including the rates for that service. This section does not define “State commission,” “telephone service,” or “jurisdiction.”
Nothing contained in this chapter shall be construed to deprive any State commission, board, or other agency of jurisdiction, under any State law, now or hereafter effective, to regulate telephone service which is not subject to regulation by the Federal Communications Commission, under the Communications Act of 1934 [47 U.S.C. 151 et seq.], including the rates for such service.
