“Council” applies throughout its chapter

“nutritional quality” applies throughout its chapter
the term “nutritional quality” means— (A) the appropriate levels of individual nutrients in the diet; (B) the appropriate levels between nutrients in the diet; (C) the bioavailability of nutrients such as absorption, digestion, and utilization; and (D) the nutritional importance of nonnutrient substances such as fiber, phytate, and such substances that are naturally found in the food supply; and;
“Secretaries” applies throughout its chapter
the term “Secretaries” means the Secretary of Agriculture and the Secretary of Health and Human Services, acting jointly.
“identified population subgroups” applies in that section
the term “identified population subgroups” shall include, but not be limited to, groups based on factors such as age, sex, or race. (c) Existing authority not affected This section does not place any limitations on— (1) the conduct or support of any scientific or medical research by any Federal agency; (2) the presentation of any scientific or medical findings or the exchange or review of scientific or medical information by any Federal agency; or (3) the authority of the Food and Drug Administration under the provisions of the Federal Food, Drug, and Cosmetic Act ( 21 U.S.C. 321 1 et seq.).

The term “agricultural commodity” means any agricultural commodity, food, feed, fiber, or livestock (including livestock as it is defined in section 1471(2) of this title and insects), and any product thereof. (2) Developing country
“developing country” applies throughout its chapter
The term “developing country” means a country that— (A) has a shortage of foreign exchange earnings and has difficulty accessing sufficient commercial credit to meet all of its food needs, as determined by the Secretary; and (B) has the potential to become a commercial market for agricultural commodities. (3) Secretary
“independent states of the former Soviet Union” applies in that section
The term “independent states of the former Soviet Union” means the following: Armenia, Azerbaijan, Belarus, Georgia, Kazakhstan, Kyrgyzstan, Moldova, Russia, Tajikistan, Turkmenistan, Ukraine, and Uzbekistan.

“United States” applies throughout its chapter
The term “United States” includes each of the States, the District of Columbia, Puerto Rico, and the territories and possessions of the United States. (7) United States agricultural commodity
“United States agricultural commodity” applies throughout its chapter
The term “United States agricultural commodity” means— (A) an agricultural commodity or product entirely produced in the United States; or (B) a product of an agricultural commodity— (i) 90 percent or more of the agricultural components of which by weight, excluding packaging and added water, is entirely produced in the United States; and (ii) that the Secretary determines to be a high value agricultural product. For purposes of this paragraph, fish entirely produced in the United States include fish harvested by a documented fishing vessel as defined in title 46 in waters that are not waters (including the territorial sea) of a foreign country.
“long term” applies in that section
the term “long term” means a period of 10 or more years. (2) Guarantees In administering the export credit guarantees authorized under this section, the Secretary shall— (A) develop an approach to risk evaluation that facilitates accurate country risk designations and timely adjustments to the designations (on an ongoing basis) in response to material changes in country risk conditions, with ongoing opportunity for input and evaluation from the private sector; (B) adjust risk-based guarantees as necessary to ensure program effectiveness and United States competitiveness; (C) work with industry to ensure, to the maximum extent practicable, that risk-based fees associated with the guarantees …
“eligible trade organization” applies in that section
the term “eligible trade organization” means— (A) a United States agricultural trade organization or regional State-related organization that promotes the export and sale of United States agricultural commodities and that does not stand to profit directly from specific sales of United States agricultural commodities; (B) a cooperative organization or State agency that promotes the sale of United States agricultural commodities; or (C) a private organization that promotes the export and sale of United States agricultural commodities if the Secretary determines that such organization would significantly contribute to United States export market development.
“emerging market” applies in that section
the term “emerging market” means any country, foreign territory, customs union, or other economic market that the Secretary determines— (A) is taking steps toward a market-oriented economy through the food, agriculture, or rural business sectors of its economy; and (B) has the potential to provide a viable and significant market for United States agricultural commodities.
“agribusiness” applies throughout its subchapter
The term “agribusiness” includes a producer or organization engaged in an agricultural enterprise with a profit motive. (5) The term “extension” shall have the same meaning given to that term by section 3103 of this title .;
“integrated crop management” applies throughout its subchapter
The term “integrated crop management” means an agricultural management system that integrates all controllable agricultural production factors for long-term sustained productivity, profitability, and ecological soundness.;
“integrated resource management” applies throughout its subchapter
The term “integrated resource management” means livestock management which utilizes an interdisciplinary systems approach which integrates all controllable agricultural production practices to provide long-term sustained productivity and profitable production of safe and wholesome food in an environmentally sound manner.;
“nonprofit organization” applies throughout its subchapter
The term “nonprofit organization” means an organization, group, institute, or institution that— (A) has a demonstrated capacity to conduct agricultural research or education programs; (B) has experience in research, demonstration, education, or extension in sustainable agricultural practices and systems; and (C) qualifies as a nonprofit organization under section 501(c) of title 26 .
“Secretary” applies throughout its subchapter
The term “Secretary” means the Secretary of Agriculture.;
“State” applies throughout its subchapter
The term “State” means each of the 50 States, the District of Columbia, the Commonwealth of Puerto Rico, Guam, the Virgin Islands of the United States, American Samoa, the Commonwealth of the Northern Mariana Islands, the Trust Territory of the Pacific Islands, or federally recognized Indian tribes. (8) The term “State agricultural experiment stations” shall have the same meaning given to that term by section 3103 of this title .;
“appropriate field office personnel” applies in that section
the term “appropriate field office personnel” includes employees of the National Institute of Food and Agriculture, Soil Conservation Service, and other appropriate Department of Agriculture personnel, as determined by the Secretary, whose activities involve the provision of agricultural production and conservation information to agricultural producers. (i) Authorization of appropriations There are authorized to be appropriated to carry out the National Training Program $20,000,000 for each of fiscal years 2013 through 2023.

The term “Director” means the Director of the National Genetic Resources Program. (b) Authorization of appropriations There are authorized to be appropriated to carry out this subchapter— (1) such sums as are necessary for each of fiscal years 1991 through 2013; and (2) $1,000,000 for each of fiscal years 2014 through 2023.

The term “first handler” means the first person who buys or takes possession of pecans from a grower for marketing. If a grower markets pecans directly to consumers, such grower shall be considered the first handler with respect to pecans grown by such grower. (8) Grower
“grower” applies throughout its chapter
The term “grower” means any person engaged in the production and sale of pecans in the United States who owns, or who shares the ownership and risk of loss of, such pecans. (9) Grower-sheller
“grower-sheller” applies throughout its chapter
The term “grower-sheller” means a person who— (A) shells pecans, or has pecans shelled for such person, in the United States; and (B) during the immediately previous year, grew 50 percent or more of the pecans such person shelled or had shelled for such person. (10) Handle
“handle” applies throughout its chapter
The term “handle” means receipt of in-shell pecans by a sheller or first handler, including pecans produced by such sheller or first handler. (11) Importer
“importer” applies throughout its chapter
The term “importer” means any person who imports pecans from outside of the United States for sale in the United States. (12) Industry information
“in-shell pecan” applies throughout its chapter
The term “in-shell pecan” means a pecan that has a shell that has not been removed. (14) To market

The term “industry information” means information and programs that will lead to the development of new markets and marketing strategies, increased efficiency, and activities to enhance the image of the pecan industry. (13) In-shell pecan
“member” applies throughout its chapter

The term “promotion” means any action taken by the Board, pursuant to this chapter, to present a favorable image of pecans to the public with the express intent of improving the competitive position of pecans in the marketplace and stimulating sales of pecans, including paid advertising. (20) Research
“research” applies throughout its chapter
The term “research” means any type of test, study, or analysis designed to advance the image, desirability, usage, marketability, production, product development, or quality of pecans. (21) Secretary
“Secretary” applies throughout its chapter
The term “Secretary” means the Secretary of Agriculture. (22) Shell
“shell” applies throughout its chapter
The term “shell” means to remove the shell from an in-shell pecan. (23) Shelled pecan
“shelled pecan” applies throughout its chapter
The term “shelled pecan” means a pecan kernel, or portion of a kernel, after the pecan shell has been removed. (24) Sheller
“sheller” applies throughout its chapter
The term “sheller” means any person who— (A) shells pecans or has pecans shelled for the account of such person; and (B) during the immediately previous year, purchased more than 50 percent of the pecans such person shelled or had shelled for such account. (25) State
“State” applies throughout its chapter
The term “State” means any of the several States, the District of Columbia and the Commonwealth of Puerto Rico. (26) United States
“to market” applies throughout its chapter
The term “to market” means to sell or offer to dispose of pecans in any channel of commerce. (15) Member

The term “marketing” means the sale or other disposition of mushrooms in any channel of commerce. (9) Mushrooms
“mushrooms” applies throughout its chapter
The term “mushrooms” means all varieties of cultivated mushrooms grown within the United States for the fresh market, or imported into the United States for the fresh market, that are marketed, except that such term shall not include mushrooms that are commercially marinated, canned, frozen, cooked, blanched, dried, packaged in brine, or otherwise processed, as may be determined by the Secretary. (10) Person
“person” applies throughout its chapter
The term “person” means any individual, group of individuals, partnership, corporation, association, cooperative, or any other legal entity. (11) Producer
“producer” applies throughout its chapter
The term “producer” means any person engaged in the production of mushrooms who owns or who shares the ownership and risk of loss of such mushrooms and who produces, on average, over 500,000 pounds of mushrooms per year. (12) Promotion

The term “marketing” means the sale or other disposition of soybeans or soybean products in any channel of commerce. (9) Net market price
“net market price” applies throughout its chapter
The term “net market price” means— (A) except as provided in subparagraph (B), the sales price or other value received by a producer for soybeans after adjustments for any premium or discount based on grading or quality factors, as determined by the Secretary; or (B) for soybeans pledged as collateral for a loan issued under any price support loan program administered by the Commodity Credit Corporation, the principal amount of the loan. “order” applies throughout its chapter
The term “order” means an order issued under section 6303 of this title . (11) Person

The term “promotion” means any action, including paid advertising, technical assistance, and trade servicing activities, to enhance the image or desirability of soybeans or soybean products in domestic and foreign markets, and any activity designed to communicate to consumers, importers, processors, wholesalers, retailers, government officials, or others information relating to the positive attributes of soybeans or soybean products or the benefits of importation, use, or distribution of soybeans and soybean products. (14) Qualified State soybean board
“qualified State soybean board” applies throughout its chapter
The term “qualified State soybean board” means a State soybean promotion entity that is authorized by State law. If no such entity exists in a State,

The term “research” means any type of study to advance the image, desirability, marketability, production, product development, quality, or functional or nutritional value of soybeans or soybean products, including any research activity designed to identify and analyze barriers to export sales of soybeans and soybean products. “soybean products” applies throughout its chapter
The term “soybean products” means products produced in whole or in part from soybeans or soybean by-products. (18) Soybeans

The term “advertising” means any advertising or promotion program involving only fluid milk products and directed toward increasing the general demand for fluid milk products. (2) Board

The term “fluid milk processor” means any person who processes and markets commercially more than 3,000,000 pounds of fluid milk products in consumer-type packages per month (excluding products delivered directly to the place of residence of a consumer). (5) Department
“fluid milk product” applies throughout its chapter
The term “fluid milk product” has the meaning given the term in— (A) section 1000.15 of title 7, Code of Federal Regulations, subject to such amendments as may be made by the Secretary; or (B) any successor regulation. (4) Fluid milk processor
“research” applies throughout its chapter
The term “research” means market research to support advertising and promotion efforts, including educational activities, research directed to product characteristics, product development, including new products or improved technology in production, manufacturing or processing of milk and the products of milk. “Secretary” applies throughout its chapter
The term “Secretary” means the Secretary of Agriculture. (8) United States The term “United States”, except as used in sections 6410 through 6412 of this title, means the 48 contiguous States in the continental United States and the District of Columbia.

The term “agricultural product” means any agricultural commodity or product, whether raw or processed, including any commodity or product derived from livestock that is marketed in the United States for human or livestock consumption. (2) Botanical pesticides
“botanical pesticides” applies throughout its chapter
The term “botanical pesticides” means natural pesticides derived from plants. (3) Certifying agent (A) In general
“certified organic farm” applies throughout its chapter
The term “certified organic farm” means a farm, or portion of a farm, or site where agricultural products or livestock are produced, that is certified by the certifying agent under this chapter as utilizing a system of organic farming as described by this chapter. (5) Certified organic handling operation
“certified organic handling operation” applies throughout its chapter
The term “certified organic handling operation” means any operation, or portion of any handling operation, that is certified by the certifying agent under this chapter as utilizing a system of organic handling as described under this chapter. (6) Crop year
“certifying agent” applies throughout its chapter
The term “certifying agent” means the chief executive officer of a State or, in the case of a State that provides for the Statewide election of an official to be responsible solely for the administration of the agricultural operations of the State, such official, and any person (including private entities) who is accredited by the Secretary as a certifying agent for the purpose of certifying a farm or handling operation as a certified organic farm or handling operation in accordance with this chapter. (B) Foreign operations When used in the context of a certifying agent operating in a foreign country,

The term “governing State official” means the chief executive official of a State or, in the case of a State that provides for the Statewide election of an official to be responsible solely for the administration of the agricultural operations of the State, such official, who administers an organic certification program under this chapter. “handler” applies throughout its chapter
The term “handler” means any person engaged in the business of handling agricultural products, except such term shall not include final retailers of agricultural products that do not process agricultural products. (10) Handling operation
“handling operation” applies throughout its chapter
The term “handling operation” means any operation or portion of an operation (except final retailers of agricultural products that do not process agricultural products) that— (A) receives or otherwise acquires agricultural products; and (B) processes, packages, or stores such products. (11) Livestock
“livestock” applies throughout its chapter
The term “livestock” means any cattle, sheep, goats, swine, poultry, equine animals used for food or in the production of food, fish used for food, wild or domesticated game, or other nonplant life. (12) National List
“National List” applies throughout its chapter
The term “National List” means a list of approved and prohibited substances as provided for in section 6517 of this title . (13) National organic program import certificate
“national organic program import certificate” applies throughout its chapter
The term “national organic program import certificate” means a form developed for purposes of the program under this chapter— (A) to provide documentation sufficient to verify that an agricultural product imported for sale in the United States satisfies the requirement under section 6514(c) of this title ; (B) which shall include, at a minimum, information sufficient to indicate, with respect to the agricultural product— (i) the origin; (ii) the destination; (iii) the certifying agent issuing the national organic program import certificate; (iv) the harmonized tariff code, if a harmonized tariff code exists for the agricultural product; (v) the total weight; and (vi) the organic standard to …
“organic plan” applies throughout its chapter
The term “organic plan” means a plan of management of an organic farming or handling operation that has been agreed to by the producer or handler and the certifying agent and that includes written plans concerning all aspects of agricultural production or handling described in this chapter including crop rotation and other practices as required under this chapter. (15) Organically produced
“organically produced” applies throughout its chapter
The term “organically produced” means an agricultural product that is produced and handled in accordance with this chapter. (16) Person
“person” applies throughout its chapter
The term “person” means an individual, group of individuals, corporation, association, organization, cooperative, or other entity. (17) Pesticide
“pesticide” applies throughout its chapter
The term “pesticide” means any substance which alone, in chemical combination, or in any formulation with one or more substances, is defined as a pesticide in the Federal Insecticide, Fungicide, and Rodenticide Act ( 7 U.S.C. 136 et seq.). (18) Processing
“processing” applies throughout its chapter
The term “processing” means cooking, baking, heating, drying, mixing, grinding, churning, separating, extracting, cutting, fermenting, eviscerating, preserving, dehydrating, freezing, or otherwise manufacturing, and includes the packaging, canning, jarring, or otherwise enclosing food in a container. (19) Producer
“producer” applies throughout its chapter
The term “producer” means a person who engages in the business of growing or producing food or feed. (20) Secretary
“Secretary” applies throughout its chapter
The term “Secretary” means the Secretary of Agriculture. (21) State organic certification program
“State organic certification program” applies throughout its chapter
The term “State organic certification program” means a program that meets the requirements of section 6506 of this title , is approved by the Secretary, and that is designed to ensure that a product that is sold or labeled as “organically produced” under this chapter is produced and handled using organic methods. (22) Synthetic
“synthetic” applies throughout its chapter
The term “synthetic” means a substance that is formulated or manufactured by a chemical process or by a process that chemically changes a substance extracted from naturally occurring plant, animal, or mineral sources, except that such term shall not apply to substances created by naturally occurring biological processes.
“action team” applies throughout its subchapter
The term “action team” means a rural natural resources and economic diversification action team established by the Secretary pursuant to section 6613(b) of this title .;
“economically disadvantaged” applies throughout its subchapter
The term “economically disadvantaged” means economic hardship due to the loss of jobs or income (labor or proprietor) derived from forestry, the wood products industry, or related commercial enterprises such as recreation and tourism in the national forest.;
“rural community” applies throughout its subchapter
The term “rural community” means— (A) any town, township, municipality, or other similar unit of general purpose local government, or any area represented by a not-for-profit corporation or institution organized under State or Federal law to promote broad based economic development, or unit of general purpose local government, as approved by the Secretary, that has a population of not more than 10,000 individuals, is located within a county in which at least 15 percent of the total primary and secondary labor and proprietor income is derived from forestry, wood products, and forest-related industries such as recreation, forage production, and tourism and that is located within the boundary, …

“designated rural development program” applies in that section
the term “designated rural development program” means a program carried out under section 1924(b), 1926(a), or 1932(e) of this title for which funds are available at any time during the fiscal year.

The term “Advisory Council” means the Greenhouse Gas Technical Assistance Provider and Third-Party Verifier Program Advisory Council established under subsection (f)(1). (2) Agriculture or forestry credit

The term “covered entity” means a person or entity, including a private business, non-profit organization, or public agency, that either— (A) is a provider of technical assistance to farmers, ranchers, or private forest landowners in carrying out sustainable land use management practices that prevent, reduce, or mitigate greenhouse gas emissions (including through the sequestration of carbon); or (B) is a third-party verifier entity that conducts the verification of the processes described in protocols for voluntary environmental credit markets.
