submitted 1 year ago by Pub. L. 119-21 to r/title-8-ALIENS-AND-NATIONALITY · 369 words · no verdicts yet
The Secretary of Homeland Security must charge a specified fee to an alien ordered removed in absentia who is later arrested by U.S. Immigration and Customs Enforcement, unless the order was rescinded. The section sets the fee, directs how it is distributed, and bars waivers or reductions.
(a) In general. As partial reimbursement for the cost of arresting an alien covered by this section, the Secretary of Homeland Security must require that alien to pay the amount in subsection (b), unless subsection (c) applies. The fee applies when the alien: (1) was ordered removed in absentia under section 1229a(b)(5) of this title; and (2) was later arrested by U.S. Immigration and Customs Enforcement.
(b) Amount specified. (1) Initial amount. For fiscal year 2025, the amount is the greater of: (A) $5,000; or (B) an amount the Secretary of Homeland Security sets by rule. (2) Annual adjustments for inflation. In fiscal year 2026 and each later fiscal year, calculate the amount by adding: (A) the fee required for the most recently completed fiscal year; and (B) that amount multiplied by the percentage, if any, by which the Consumer Price Index for All Urban Consumers for the July before the adjustment takes effect is higher than the index for the same month of the preceding calendar year. Round the result down to the next multiple of $10.
(c) Exception. The fee does not apply to an alien ordered removed in absentia if the order was rescinded under section 1229a(b)(5)(C) of this title.
(d) Disposition of removal in absentia fees. During each fiscal year: (1) 50 percent of fees collected under this section: (A) must be credited to U.S. Immigration and Customs Enforcement; (B) must be deposited in the Detention and Removal Office Fee Account; and (C) may be kept and spent by U.S. Immigration and Customs Enforcement without another appropriation; and (2) all collected amounts not credited to U.S. Immigration and Customs Enforcement under paragraph (1) must be deposited in the Treasury's general fund.
(e) No fee waiver. A fee required by this section may not be waived or reduced.
As partial reimbursement for the cost of arresting an alien described in this section, the Secretary of Homeland Security, except as provided in subsection (c), shall require the payment of a fee, equal to the amount specified in subsection (b) on any alien who—
is ordered removed in absentia pursuant to section 1229a(b)(5) of this title; and
is subsequently arrested by U.S. Immigration and Customs Enforcement.
For fiscal year 2025, the amount specified in this section shall be the greater of—
$5,000; or
such amount as the Secretary of Homeland Security may establish, by rule.
During fiscal year 2026, and during each subsequent fiscal year, the amount specified in this section shall be equal to the sum of—
the amount of the fee required under this subsection for the most recently concluded fiscal year; and
the product resulting from the multiplication of the amount referred to in subparagraph (A) by the percentage (if any) by which the Consumer Price Index for All Urban Consumers for the month of July preceding the date on which such adjustment takes effect exceeds the Consumer Price Index for All Urban Consumers for the same month of the preceding calendar year, rounded to the next lowest multiple of $10.
The fee described in this section shall not apply to any alien who was ordered removed in absentia if such order was rescinded pursuant to section 1229a(b)(5)(C) of this title.
During each fiscal year—
50 percent of the fees collected pursuant to this section—
shall be credited to U.S. Immigration and Customs Enforcement;
shall be deposited into the Detention and Removal Office Fee Account; and
may be retained and expended by U.S. Immigration and Customs Enforcement without further appropriation; and
any amounts collected pursuant to this section that are not credited to U.S. Immigration and Customs Enforcement pursuant to paragraph (1) shall be deposited into the general fund of the Treasury.
Fees required to be paid under this section shall not be waived or reduced.
