9 U.S.C. § 306Applicable rules of Inter-American Commercial Arbitration Commission

submitted 36 years ago by Pub. L. 101-369 to r/title-9-ARBITRATION · 117 words · no verdicts yet

in plain englishAI-generated · not legal advice

For arbitration cases under this chapter, the applicable rules are the Inter-American Commercial Arbitration Commission's rules as they stood on July 1, 1988. The Secretary of State can update this by regulation if the Commission later changes its rules.

(a) For this chapter, the "rules of procedure" of the Inter-American Commercial Arbitration Commission, mentioned in Article 3 of the Inter-American Convention, are the rules the Commission adopted on July 1, 1988 -- unless subsection (b) changes that. (b) If the Commission later changes those rules through its own amendment process, the Secretary of State may issue a regulation -- following the notice-and-comment process in section 553 of title 5, and staying true to the Convention's goals -- saying that the new, amended rules apply for this chapter too.
