submitted 68 years ago by Pub. L. 85-861 to r/title-10-ARMED-FORCES · 142 words · no verdicts yet

in plain englishAI-generated · not legal advice

This section directs the Secretary of Defense to set charges for dependents' inpatient medical and dental care and permits minimum charges for outpatient care when necessary to limit excessive demand. Money collected for subsistence and care must support the appropriation for the facility that provided the care.

(a) After consulting the other Secretaries who administer the relevant programs, the Secretary of Defense must set fair charges for inpatient medical and dental care provided to dependents under section 1076 of this title. The charge or charges must apply equally to every class of dependents. (b) To discourage excessive requests for medical and dental care under section 1076 of this title, uniform minimum charges may be imposed for outpatient care. The charges may not exceed any amounts the Secretary of Defense sets after consulting the other administering Secretaries and finding that the charges are necessary. This section does not define "fair charges," "uniform minimum charges," or "excessive demands." (c) Money received for subsistence and for medical and dental care provided under section 1076 of this title must be deposited to the credit of the appropriation that supports maintaining and operating the facility that provided the care.
