“acquisition workforce” applies throughout this title
The term “acquisition workforce” means the persons serving in acquisition positions within the Department of Defense, as designated pursuant to section 1721(a) of this title .;
“active duty” applies throughout this title
The term “active duty” means full-time duty in the active military service of the United States, including sustained duty in the Space Force. Such term includes full-time training duty, annual training duty, and attendance, while in the active military service, at a school designated as a service school by law or by the Secretary of the military department concerned. Such term does not include full-time National Guard duty.;
“active duty for a period of more than 30 days” applies throughout this title
The term “active duty for a period of more than 30 days” means active duty under a call or order that does not specify a period of 30 days or less.;
“Active Guard and Reserve” applies throughout this title
The term “Active Guard and Reserve” means a member of a reserve component who is on active duty pursuant to section 12301(d) of this title or, if a member of the Army National Guard or Air National Guard, is on full-time National Guard duty pursuant to section 502(f) of title 32 , and who is performing Active Guard and Reserve duty. (c) Reserve Components .— The following definitions relating to the reserve components apply in this title:;
“active Guard and Reserve duty” applies throughout this title
The term “active Guard and Reserve duty” means active duty performed by a member of a reserve component of the Army, Navy, Air Force, or Marine Corps, or full-time National Guard duty performed by a member of the National Guard pursuant to an order to full-time National Guard duty, for a period of 180 consecutive days or more for the purpose of organizing, administering, recruiting, instructing, or training the reserve components. (B) Such term does not include the following: (i) Duty performed as a member of the Reserve Forces Policy Board provided for under section 10301 of this title . (ii) Duty performed as a property and fiscal officer under section 708 of title 32 .
“active service” applies throughout this title
The term “active service” means service on active duty or full-time National Guard duty.;
“active status” applies throughout this title
The term “active status” means the status of a member of a reserve component who is not in the inactive Army National Guard or inactive Air National Guard, on an inactive status list, or in the Retired Reserve.;
“active-duty list” applies throughout this title
The term “active-duty list” means a single list for the Army, Navy, Air Force, Marine Corps, or Space Force (required to be maintained under section 620 of this title ) which contains the names of all officers of that armed force, other than officers described in section 641 of this title , who are serving on active duty.;
“Air National Guard” applies throughout this title
The term “Air National Guard” means that part of the organized militia of the several States and Territories, Puerto Rico, and the District of Columbia, active and inactive, that— (A) is an air force; (B) is trained, and has its officers appointed, under the sixteenth clause of section 8, article I, of the Constitution; (C) is organized, armed, and equipped wholly or partly at Federal expense; and (D) is federally recognized.;
“Air National Guard of the United States” applies throughout this title
The term “Air National Guard of the United States” means the reserve component of the Air Force all of whose members are members of the Air National Guard. (6) The term “reserve”, with respect to an enlistment, appointment, grade, or office, means enlistment, appointment, grade, or office held as a Reserve of one of the armed forces.;
“armed forces” applies throughout this title
The term “armed forces” means the Army, Navy, Air Force, Marine Corps, Space Force, and Coast Guard.;
“Army National Guard” applies throughout this title
The term “Army National Guard” means that part of the organized militia of the several States and Territories, Puerto Rico, and the District of Columbia, active and inactive, that— (A) is a land force; (B) is trained, and has its officers appointed, under the sixteenth clause of section 8, article I, of the Constitution; (C) is organized, armed, and equipped wholly or partly at Federal expense; and (D) is federally recognized.;
“Army National Guard of the United States” applies throughout this title
The term “Army National Guard of the United States” means the reserve component of the Army all of whose members are members of the Army National Guard.;
“authorized strength” applies throughout this title
The term “authorized strength” means the largest number of members authorized to be in an armed force, a component, a branch, a grade, or any other category of the armed forces. (12) The term “regular”, with respect to an enlistment, appointment, grade, or office, means enlistment, appointment, grade, or office in a regular component of an armed force.;
“base closure law” applies throughout this title
The term “base closure law” means the following: (A) Section 2687 of this title . (B) The Defense Base Closure and Realignment Act of 1990 (part A of title XXIX of Public Law 101–510 ; 10 U.S.C. 2687 note). (C) Title II of the Defense Authorization Amendments and Base Closure and Realignment Act ( Public Law 100–526 ; 10 U.S.C. 2687 note).;
“climate resilience” applies throughout this title
The term “climate resilience” means the capability to avoid, prepare for, minimize the effect of, adapt to, and recover from, extreme weather, or from anticipated or unanticipated changes in environmental conditions, that do (or have the potential to) adversely affect the national security of the United States or of allies and partners of the United States.;
“commissioned officer” applies throughout this title
The term “commissioned officer” includes a commissioned warrant officer.;
“congressional defense committees” applies throughout this title
The term “congressional defense committees” means— (A) the Committee on Armed Services and the Committee on Appropriations of the Senate; and (B) the Committee on Armed Services and the Committee on Appropriations of the House of Representatives.;
“contingency operation” applies throughout this title
The term “contingency operation” means a military operation that— (A) is designated by the Secretary of Defense as an operation in which members of the armed forces are or may become involved in military actions, operations, or hostilities against an enemy of the United States or against an opposing military force; or (B) results in the call or order to, or retention on, active duty of members of the uniformed services under section 688, 12301(a), 12302, 12304, 12304a, 12305, or 12406 of this title, chapter 13 of this title, section 3713 of title 14 , or any other provision of law during a war or during a national emergency declared by the President or Congress.;
“Defense Agency” applies throughout this title
The term “Defense Agency” means an organizational entity of the Department of Defense— (A) that is established by the Secretary of Defense under section 191 of this title (or under the second sentence of section 125(d) of this title (as in effect before October 1, 1986 )) to perform a supply or service activity common to more than one military department (other than such an entity that is designated by the Secretary as a Department of Defense Field Activity); or (B) that is designated by the Secretary of Defense as a Defense Agency.;
“dental officer” applies throughout this title
The term “dental officer” means an officer of the Dental Corps of the Army, an officer of the Dental Corps of the Navy, or an officer of the Air Force designated as a dental officer.;
“Department of Defense Field Activity” applies throughout this title
The term “Department of Defense Field Activity” means an organizational entity of the Department of Defense— (A) that is established by the Secretary of Defense under section 191 of this title (or under the second sentence of section 125(d) of this title (as in effect before October 1, 1986 )) to perform a supply or service activity common to more than one military department; and (B) that is designated by the Secretary of Defense as a Department of Defense Field Activity.;
“energy resilience” applies throughout this title
The term “energy resilience” means the ability to avoid, prepare for, minimize, adapt to, and recover from anticipated and unanticipated energy disruptions in order to ensure energy availability and reliability sufficient to provide for mission assurance and readiness, including mission essential operations related to readiness, and to execute or rapidly reestablish mission essential requirements. (7) Energy security .—
“energy security” applies throughout this title
The term “energy security” means having assured access to reliable supplies of energy and the ability to protect and deliver sufficient energy to meet mission essential requirements. (8) Military installation resilience .—
“enlisted member” applies throughout this title
The term “enlisted member” means a person in an enlisted grade.;
“executive part of the department” applies throughout this title
The term “executive part of the department” means the executive part of the Department of Defense, Department of the Army, Department of the Navy, or Department of the Air Force, as the case may be, at the seat of government.;
“extreme weather” applies throughout this title
The term “extreme weather” means recurrent flooding, drought, desertification, wildfires, thawing permafrost, sea level fluctuation, changes in mean high tides, or any other weather-related event, or anticipated change in environmental conditions, that present (or are projected to present) a recurring annual threat to the climate security of the United States or of allies and partners of the United States.;
“flag officer” applies throughout this title
The term “flag officer” means an officer of the Navy or Coast Guard serving in or having the grade of admiral, vice admiral, rear admiral, or rear admiral (lower half).;
“full-time National Guard duty” applies throughout this title
The term “full-time National Guard duty” means training or other duty, other than inactive duty, performed by a member of the Army National Guard of the United States or the Air National Guard of the United States in the member’s status as a member of the National Guard of a State or territory, the Commonwealth of Puerto Rico, or the District of Columbia under section 316, 502, 503, 504, or 505 of title 32 for which the member is entitled to pay from the United States or for which the member has waived pay from the United States. (6);
“general officer” applies throughout this title
The term “general officer” means an officer of the Army, Air Force, Marine Corps, or Space Force serving in or having the grade of general, lieutenant general, major general, or brigadier general.;
“grade” applies throughout this title
The term “grade” means a step or degree, in a graduated scale of office or military rank, that is established and designated as a grade by law or regulation.;
“inactive-duty training” applies throughout this title
The term “inactive-duty training” means— (A) duty prescribed for Reserves, or a member of the Space Force, by the Secretary concerned under section 206 of title 37 or any other provision of law; and (B) special additional duties authorized for Reserves, or a member of the Space Force, by an authority designated by the Secretary concerned and performed by them on a voluntary basis in connection with the prescribed training or maintenance activities of the units to which they are assigned. Such term includes those duties when performed by Reserves in their status as members of the National Guard.
“major weapon system” applies throughout this title
The term “major weapon system” means a weapon system acquired pursuant to a major defense acquisition program (as that term is defined in section 4201 of this title ). (b) Personnel Generally .— The following definitions relating to military personnel apply in this title:;
“medical officer” applies throughout this title
The term “medical officer” means an officer of the Medical Corps of the Army, an officer of the Medical Corps of the Navy, or an officer in the Air Force designated as a medical officer.;
“military departments” applies throughout this title
The term “military departments” means the Department of the Army, the Department of the Navy, and the Department of the Air Force.;
“military installation resilience” applies throughout this title
The term “military installation resilience” means the capability of a military installation to avoid, prepare for, minimize the effect of, adapt to, and recover from extreme weather events, anticipated or unanticipated changes in environmental conditions, energy or water disruptions, or human-induced hazards with respect to the environment, that do, or have the potential to, adversely affect the military installation or essential transportation, logistical, or other necessary resources outside of the military installation that are necessary in order to maintain, improve, or rapidly reestablish installation mission assurance and mission-essential functions.
“military munitions” applies throughout this title
The term “military munitions” means all ammunition products and components produced for or used by the armed forces for national defense and security, including ammunition products or components under the control of the Department of Defense, the Coast Guard, the Department of Energy, and the National Guard. (B) Such term includes the following: (i) Confined gaseous, liquid, and solid propellants. (ii) Explosives, pyrotechnics, chemical and riot control agents, smokes, and incendiaries, including bulk explosives and chemical warfare agents.
“National Guard” applies throughout this title
The term “National Guard” means the Army National Guard and the Air National Guard.;
“officer” applies throughout this title
The term “officer” means a commissioned or warrant officer.;
“operational range” applies throughout this title
The term “operational range” means a range that is under the jurisdiction, custody, or control of the Secretary of a military department and— (A) that is used for range activities, or (B) although not currently being used for range activities, that is still considered by the Secretary to be a range and has not been put to a new use that is incompatible with range activities. (4) Military munitions .—;
“pay” applies throughout this title
The term “pay” includes basic pay, special pay, retainer pay, incentive pay, retired pay, and equivalent pay, but does not include allowances.;
“possessions” applies throughout this title
The term “possessions” includes the Virgin Islands, Guam, American Samoa, and the Guano Islands, so long as they remain possessions, but does not include any Commonwealth.;
“range activities” applies throughout this title
The term “range activities” means— (A) research, development, testing, and evaluation of military munitions, other ordnance, and weapons systems; and (B) the training of members of the armed forces in the use and handling of military munitions, other ordnance, and weapons systems. (3) Operational range .—
“rank” applies throughout this title
The term “rank” means the order of precedence among members of the armed forces.;
“rate” applies throughout this title
The term “rate” means the name (such as “chief boatswain’s mate”) prescribed for members in the same rating or other category who are in the same grade (such as chief petty officer or seaman apprentice). (10) The term “original”, with respect to the appointment of a member of the armed forces in a regular or reserve component, refers to that member’s most recent appointment in that component that is neither a promotion nor a demotion and, with respect to the appointment of a member of the armed forces in the Space Force, refers to that member’s most recent appointment in the Space Force that is neither a promotion nor a demotion.;
“rating” applies throughout this title
The term “rating” means the name (such as “boatswain’s mate”) prescribed for members of an armed force in an occupational field.
“reserve active-status list” applies throughout this title
The term “reserve active-status list” means a single list for the Army, Navy, Air Force, or Marine Corps (required to be maintained under section 14002 of this title ) that contains the names of all officers of that armed force except warrant officers (including commissioned warrant officers) who are in an active status in a reserve component of the Army, Navy, Air Force, or Marine Corps and are not on an active-duty list. (d) Duty Status .— The following definitions relating to duty status apply in this title:;
“Secretary concerned” applies throughout this title
The term “Secretary concerned” means— (A) the Secretary of the Army, with respect to matters concerning the Army; (B) the Secretary of the Navy, with respect to matters concerning the Navy, the Marine Corps, and the Coast Guard when it is operating as a service in the Department of the Navy; (C) the Secretary of the Air Force, with respect to matters concerning the Air Force and the Space Force; and (D) the Secretary of Homeland Security, with respect to matters concerning the Coast Guard when it is not operating as a service in the Department of the Navy.;
“service acquisition executive” applies throughout this title
The term “service acquisition executive” means the civilian official within a military department who is designated as the service acquisition executive for purposes of regulations and procedures providing for a service acquisition executive for that military department.;
“space force active status” applies throughout this title
The term “space force active status” means the status of a member of the Space Force who is not in a space force inactive status and is not retired.;
“space force inactive status” applies throughout this title
The term “space force inactive status” means the status of a member of the Space Force who is designated by the Secretary of the Air Force, under regulations prescribed by the Secretary, as being in a space force inactive status.;
“space force retired status” applies throughout this title
The term “space force retired status” means the status of a member of the Space Force who— (A) is receiving retired pay ; or (B) but for being under the eligibility age applicable under section 12731 of this title , would be eligible for retired pay under chapter 1223 of this title.;
“supplies” applies throughout this title
The term “supplies” includes material, equipment, and stores of all kinds.;
“sustained duty” applies throughout this title
The term “sustained duty” means full-time duty by a member of the Space Force ordered to such duty by an authority designated by the Secretary of the Air Force— (A) in the case of an officer— (i) to fulfill the terms of an active-duty service commitment incurred by the officer under any provision of law; or (ii) with the consent of the officer; and (B) in the case of an enlisted member, with the consent of the enlisted member as specified in the terms of the member’s enlistment or reenlistment agreement.
“unexploded ordnance” applies throughout this title
The term “unexploded ordnance” means military munitions that— (A) have been primed, fused, armed, or otherwise prepared for action; (B) have been fired, dropped, launched, projected, or placed in such a manner as to constitute a hazard to operations, installations, personnel, or material; and (C) remain unexploded, whether by malfunction, design, or any other cause. (6) Energy resilience .—
“uniformed services” applies throughout this title
The term “uniformed services” means— (A) the armed forces; (B) the commissioned corps of the National Oceanic and Atmospheric Administration; and (C) the commissioned corps of the Public Health Service. (6) The term “department”, when used with respect to a military department, means the executive part of the department and all field headquarters, forces, reserve components, installations, activities, and functions under the control or supervision of the Secretary of the department.
“warrant officer” applies throughout this title
The term “warrant officer” means a person who holds a commission or warrant in a warrant officer grade.;
“covered defense law” applies in that section
the term “covered defense law” means— (1) this title; (2) titles 32 and 37; (3) any national defense authorization Act that authorizes funds to be appropriated for a fiscal year to the Department of Defense; and (4) any other law designated in the text thereof as a covered defense law for purposes of application of this section.
“military construction” applies in that section
the term “military construction” includes any construction, development, conversion, or extension of any kind which is carried out with respect to any military facility or installation (including any Government-owned or Government-leased industrial facility used for the production of defense articles and any facility to which section 4174 of this title applies), any activity to which section 2807 of this title applies, any activity to which chapter 1803 of this title applies, and advances to the Secretary of Transportation for the construction of defense access roads under section 210 of title 23 . Such term does not include any activity to which section 2821 or 2854 of this title applies.
“medical personnel” applies in that section
the term “medical personnel” includes— (A) in the case of the Army, members of the Medical Corps, Dental Corps, Nurse Corps, Medical Service Corps, Veterinary Corps, and Army Medical Specialist Corps; (B) in the case of the Navy, members of the Medical Corps, Dental Corps, Nurse Corps, and Medical Service Corps; (C) in the case of the Air Force, members designated as medical officers, dental officers, Air Force nurses, medical service officers, and biomedical science officers; (D) enlisted members engaged in or supporting medically related activities; and (E) such other personnel as the Secretary considers appropriate.
“combat arms battalions” applies in that section
The term “combat arms battalions” means armor, infantry, mechanized infantry, air assault infantry, airborne infantry, ranger, artillery, and combat engineer battalions and armored cavalry and air cavalry squadrons.;
“major repair work” applies in that section
The term “major repair work” means, in the case of any ship to which subsection (a) is applicable, any overhaul, modification, alteration, or conversion work which will result in a total cost to the United States of more than $10,000,000.
“major weapon system” applies in that section
The term “major weapon system” has the meaning given in section 101(a) of this title .;
“materiel availability” applies in that section
The term “materiel availability” means a measure of the percentage of the total inventory of a major weapon system that is operationally capable of performing an assigned mission.;
“materiel readiness objective” applies in that section
The term “materiel readiness objective” means the minimum required availability of each covered system that is necessary to fulfill the requirements of the strategic framework and guidance referred to in subsection (a).;
“materiel reliability” applies in that section
The term “materiel reliability” means the probability that a major weapon system will perform without failure over a specified interval.;
“operational availability” applies in that section
The term “operational availability” means a measure of the percentage of time a major weapon system is operationally capable.;
“operationally capable” applies in that section
The term “operationally capable” means a materiel condition indicating that a major weapon system is capable of performing its assigned mission and has no discrepancies with a subsystem of a major weapon system.
“defense committees” applies in that section
the term “defense committees” means— (1) the Committee on Armed Services and the Committee on Appropriations, and the Defense Subcommittee of the Committee on Appropriations, of the Senate; and (2) the Committee on Armed Services and the Committee on Appropriations, and the Subcommittee on Defense of the Committee on Appropriations, of the House of Representatives.
“new special access program” applies in that section
the term “new special access program” means a special access program that has not previously been covered in a notice and justification under this subsection. (c) (1) Whenever a change in the classification of a special access program of the Department of Defense is planned to be made or whenever classified information concerning a special access program of the Department of Defense is to be declassified and made public, the Secretary of Defense shall submit to the defense committees a report containing a description of the proposed change, the reasons for the proposed change, and notice of any public announcement planned to be made with respect to the proposed change.
“classified program” applies in that section
the term “classified program” includes any special access program, alternative compensatory control measure, or any other controlled access program.
“new program being managed under alternative compensatory control measures” applies in that section
the term “new program being managed under alternative compensatory control measures” means a program in the Department that has not previously been covered by a report under this subsection. (c) Report on Change in Classification or Declassification of Programs.— (1) In general .— Whenever a change in the classification of a program being managed under alternative compensatory control measures in the Department is planned to be made, or whenever classified information concerning a program being managed under alternative compensatory control measures in the Department is to be declassified and made public, the Secretary shall submit to the congressional defense committees a report containing …
“executive aircraft” applies in that section
The term “executive aircraft” has the meaning given such term in Department of Defense directive 4500.43, as in effect on the date of the enactment of this section.
“required use traveler” applies in that section
The term “required use traveler” has the meaning given such term in Department of Defense directive 4500.56, as in effect on the date of the enactment of this section.;
“statutory end strength” applies in that section
the term “statutory end strength” means any end-strength limitation with respect to a fiscal year that is prescribed by law for any military or civilian component of the armed forces or of the Department of Defense.
“United States” applies in that section
the term “United States” means the land area of the several States and any territory, commonwealth, or possession of the United States.
“congressional intelligence committees” applies in that section
the term “congressional intelligence committees” means the Permanent Select Committee on Intelligence of the House of Representatives and the Select Committee on Intelligence of the Senate.
“irregular warfare” applies in that section
the term “irregular warfare” means Department of Defense activities not involving armed conflict that support predetermined United States policy and military objectives conducted by, with, and through regular forces, irregular forces, groups, and individuals.
“counterintelligence” applies in that section
the terms “intelligence” and “counterintelligence” have the meaning given those terms in section 3 of the National Security Act of 1947 ( 50 U.S.C. 3003 ). (f) Quarterly Briefing .— On a quarterly basis, the Assistant Secretary of Defense for Special Operations and Low Intensity Conflict, in coordination with elements of the Department of Defense that the Assistant Secretary determines appropriate, shall provide to the congressional defense committees a briefing outlining the clandestine activities carried out pursuant to subsection (a) during the period covered by the briefing, including— (1) an update on such activities carried out in each geographic combatant command and a description of …
“intelligence” applies in that section
the terms “intelligence” and “counterintelligence” have the meaning given those terms in section 3 of the National Security Act of 1947 ( 50 U.S.C. 3003 ). (f) Quarterly Briefing .— On a quarterly basis, the Assistant Secretary of Defense for Special Operations and Low Intensity Conflict, in coordination with elements of the Department of Defense that the Assistant Secretary determines appropriate, shall provide to the congressional defense committees a briefing outlining the clandestine activities carried out pursuant to subsection (a) during the period covered by the briefing, including— (1) an update on such activities carried out in each geographic combatant command and a description of …
“operational preparation of the environment” applies in that section
the term “operational preparation of the environment” means the conduct of activities in likely or potential operational areas to set conditions for mission execution.
“medical personnel” applies in that section
the term “medical personnel” means— (1) the members of the armed forces covered by the term “medical personnel” as defined in section 115a(e)(2) 1 of this title; and (2) the civilian personnel of the Department of Defense assigned to military medical facilities.
“litigation support contractor” applies in that section
The term “litigation support contractor” means a contractor (including an expert or technical consultant) under contract with the Department of Defense to provide litigation support.;
“sensitive information” applies in that section
The term “sensitive information” means confidential commercial, financial, or proprietary information, technical data, or other privileged information.
“technical data with military or space application” applies in that section
the term “technical data with military or space application” means any blueprints, drawings, plans, instructions, computer software and documentation, or other technical information that can be used, or be adapted for use, to design, engineer, produce, manufacture, operate, repair, overhaul, or reproduce any military or space equipment or technology concerning such equipment.
“overseas unit” applies in that section
The term “overseas unit” means a unit that is located outside the United States and its territories.;
“routinely deployable unit” applies in that section
The term “routinely deployable unit” means a unit that normally deploys from its permanent home station on a periodic or rotating basis to meet peacetime operational requirements that, or to participate in scheduled training exercises that, routinely require deployments outside the United States and its territories. Such term includes a unit that is alerted for deployment outside the United States and its territories during an actual execution of a contingency plan or in support of a crisis operation.
“sensitive unit” applies in that section
The term “sensitive unit” means a unit that is primarily involved in training for the conduct of, or conducting, special activities or classified missions, including— (A) a unit involved in collecting, handling, disposing, or storing of classified information and materials; (B) a unit engaged in training— (i) special operations units; (ii) security group commands weapons stations; or (iii) communications stations; and (C) any other unit that is designated as a sensitive unit by the Secretary of Defense or, in the case of the Coast Guard when it is not operating as a service in the Navy, by the Secretary of Homeland Security.;
“unit” applies in that section
The term “unit” means a military organization of the armed forces designated as a unit by competent authority.;
“agency” applies in that section
The term “agency” has the meaning given that term in section 552(f) of title 5 .;
“international organization” applies in that section
The term “international organization” means the following: (A) A public international organization designated pursuant to section 1 of the International Organizations Immunities Act ( 59 Stat. 669 ; 22 U.S.C. 288 ) as being entitled to enjoy the privileges, exemptions, and immunities provided in such Act. (B) A public international organization created pursuant to a treaty or other international agreement as an instrument through or by which two or more foreign governments engage in some aspect of their conduct of international affairs. (C) An official mission, except a United States mission, to a public international organization referred to in subparagraph (A) or (B).
“national security official concerned” applies in that section
The term “national security official concerned” means the following: (A) The Secretary of Defense, with respect to information of concern to the Department of Defense, as determined by the Secretary. (B) The Secretary of Homeland Security, with respect to information of concern to the Coast Guard, as determined by the Secretary, but only while the Coast Guard is not operating as a service in the Navy. (C) The Secretary of Energy, with respect to information concerning the national security programs of the Department of Energy, as determined by the Secretary.;
“Department of Defense critical infrastructure security information” applies in that section
the term “Department of Defense critical infrastructure security information” means sensitive but unclassified information that, if disclosed, would reveal vulnerabilities in Department of Defense critical infrastructure that, if exploited, would likely result in the significant disruption, destruction, or damage of or to Department of Defense operations, property, or facilities, including information regarding the securing and safeguarding of explosives, hazardous chemicals, or pipelines, related to critical infrastructure or protected systems owned or operated by or on behalf of the Department of Defense, including vulnerability assessments prepared by or on behalf of the Department of …
“sensitive military operation” applies in that section
the term “sensitive military operation” means— (1) a lethal operation or capture operation conducted by the armed forces or conducted by a foreign partner in coordination with the armed forces that targets a specific individual or individuals; (2) an operation conducted by the armed forces in self-defense or in defense of foreign partners, including during a cooperative operation; or (3) an operation conducted by the armed forces to free an individual from the control of hostile foreign forces. (e) Rule of Construction .— Nothing in this section shall be construed to provide any new authority or to alter or otherwise affect the War Powers Resolution ( 50 U.S.C.
“Department of Defense sensitive activities” applies in that section
the term “Department of Defense sensitive activities” means operations, actions, activities, or programs of the Department of Defense that if compromised, could have enduring adverse effects on United States foreign policy, Department of Defense activities, or military operations, or cause significant embarrassment to the United States, its allies, or the Department of Defense. Such activities are generally handled through special access, compartmented, or other sensitive control mechanisms.
“appropriate congressional committees” applies in that section
The term “appropriate congressional committees” means— (A) the congressional defense committees; (B) the Select Committee on Intelligence, the Committee on the Judiciary, and the Committee on Commerce, Science, and Transportation of the Senate; and (C) the Permanent Select Committee on Intelligence, the Committee on the Judiciary, and the Committee on Transportation and Infrastructure of the House of Representatives. (2) The term “budget”, with respect to a fiscal year, means the budget for that fiscal year that is submitted to Congress by the President under section 1105(a) of title 31 .;

The term “contractor” means a person who— (A) performs functions that support or carry out actions authorized in this section pursuant to a contract or subcontract entered into with an entity of the Department of Defense; and (B) has completed training for the counter-unmanned aircraft system the person will use in performance of such functions, as certified by the Secretary of Defense.

The term “major defense acquisition program” means a Department of Defense acquisition program that is a major defense acquisition program for purposes of section 4201 of this title or that is designated as such a program by the Director for purposes of this section. (b) The Director is the principal adviser to the Secretary of Defense, the Under Secretary of Defense for Acquisition and Sustainment, and the Under Secretary of Defense for Research and Engineering on operational test and evaluation in the Department of Defense and the principal operational test and evaluation official within the senior management of the Department of Defense.
“operational test and evaluation” applies in that section
The term “operational test and evaluation” means— (i) the field test, under realistic combat conditions, of any item of (or key component of) weapons, equipment, or munitions for the purpose of determining the effectiveness and suitability of the weapons, equipment, or munitions for use in combat by typical military users; and (ii) the evaluation of the results of such test.;
“OSD personnel” applies in that section
the term “OSD personnel” means military and civilian personnel of the Department of Defense who are assigned to, or employed in, functions in the Office of the Secretary of Defense (including Direct Support Activities of that Office and the Washington Headquarters Services of the Department of Defense). (c) Limitation on Reassignment of Functions .— In carrying out reductions in the number of personnel assigned to, or employed in, the Office of the Secretary of Defense in order to comply with this section, the Secretary of Defense may not reassign functions solely in order to evade the requirements contained in this section.
“energetic materials” applies in that section
the term “energetic materials” means critical chemicals and formulations that— (1) release large amounts of stored chemical energy; and (2) are capable of being used as explosives, propellants, pyrotechnics, and reactive materials that— (A) create lethal effects in warheads in kinetic weapons components and systems; or (B) increase propellant performance in a weapon propulsion system as related to lethal effects, range, or speed.

The term “capital assistance” means a loan, loan guarantee, or technical assistance.;
“covered technology category” applies in that section
The term “covered technology category” means the following: (A) Advanced bulk materials. (B) Advanced manufacturing. (C) Autonomous mobile robots. (D) Battery storage. (E) Biochemicals. (F) Bioenergetics. (G) Biomass. (H) Cybersecurity. (I) Data fabric. (J) Decision science. (K) Edge computing. (L) External communication. (M) Hydrogen generation and storage. (N) Mesh networks. (O) Microelectronics assembly, testing, or packaging. (P) Microelectronics design and development. (Q) Microelectronics fabrication. (R) Microelectronics manufacturing equipment. (S) Microelectronics materials. (T) Nanomaterials and metamaterials. (U) Nuclear fission and fusion energy technologies. (V) Open RAN.
“eligible entity” applies in that section
The term “eligible entity” means— (A) an individual; (B) a corporation; (C) a partnership, which may include a public-private partnership, limited partnership, or general partnership; (D) a joint venture; (E) a trust; (F) a State, including a political subdivision or any other instrumentality of a State; (G) a Tribal government or consortium of Tribal governments; (H) any other governmental entity or public agency in the United States, including a special purpose district or public authority, including a port authority; (I) a multi-State or multi-jurisdictional group of public entities; or (J) a strategic alliance among two or more entities described in subparagraphs (A) through (I).;
“eligible investment” applies in that section
The term “eligible investment” means an investment, in the form of capital assistance provided to an eligible entity, for a technology that— (A) is in a covered technology category; and (B) is not a technology that solely has defense applications.;

“launch vehicle” applies in that section
the term “launch vehicle” has the meaning given such term in section 50902(11) of title 51 .
“budget” applies in that section
the term “budget” has the meaning given that term in section 231(f) 1 of this title. (g) Semiannual Updates on Council Meetings .— (1) Not later than February 1 and August 1 of each year, the Council shall provide to the congressional defense committees a semiannual update including, with respect to the six-month period preceding the update— (A) the dates on which the Council met and the members who attended each meeting; and (B) except as provided by paragraph (2), a summary of any decisions made by the Council pursuant to subsection (d) at each such meeting and the rationale for and options that informed such decisions.

The term “joint capability requirement” means a capability that is critical or essential to address a joint operational problem.;

The term “oversight information” means information and materials comprising analysis and justification that are prepared to support a recommendation that is made to, and approved by, the Secretary of Defense.;

The term “service chief” has the meaning given in section 3101 of this title .
“adverse impact on military operations and readiness” applies in that section
The term “adverse impact on military operations and readiness” means any adverse impact upon military operations and readiness, including flight operations, research, development, testing, and evaluation, and training, that is demonstrable and is likely to impair or degrade the ability of the armed forces to perform their warfighting missions.;
“antenna structure project” applies in that section
The term “antenna structure project”— (A) means a project to construct a structure located within two nautical miles of the geographic center of any intercontinental ballistic missile launch facility or control center that— (i) is constructed or used to transmit radio energy or that is constructed or used for the primary purpose of supporting antennas to transmit or receive radio energy (or both), and any antennas and other appurtenances mounted on the structure, from the time construction of the supporting structure begins until such time as the supporting structure is dismantled; and (ii) for which notification is required to be made to the Federal Aviation Administration pursuant to …
“energy project” applies in that section
The term “energy project” means a project that provides for the generation or transmission of electrical energy. (5) The term “governor”, with respect to a State, means the chief executive officer of the State.;
“intercontinental ballistic missile launch facility or control center” applies in that section
The term “intercontinental ballistic missile launch facility or control center” means such facilities or control centers located at the Francis E. Warren Air Force Base, the Malmstrom Air Force Base, and the Minot Air Force Base, and their respective missile fields.;
“landowner” applies in that section
The term “landowner” means a person that owns a fee interest in real property on which a proposed energy project or antenna structure project is planned to be located.;
“military installation” applies in that section
The term “military installation” has the meaning given that term in section 2801(c)(4) of this title .;
“military readiness” applies in that section
The term “military readiness” includes any training or operation that could be related to combat readiness, including testing and evaluation activities.;
“military training route” applies in that section
The term “military training route” means a training route developed as part of the Military Training Route Program, carried out jointly by the Administrator of the Federal Aviation Administration and the Secretary of Defense, for use by the armed forces for the purpose of conducting low-altitude, high-speed military training.;
“State” applies in that section
The term “State” means the several States, the District of Columbia, the Commonwealth of Puerto Rico, the Commonwealth of the Northern Mariana Islands, Guam, the United States Virgin Islands, and American Samoa.;
“unacceptable risk to the national security of the United States” applies in that section
The term “unacceptable risk to the national security of the United States” means the construction, alteration, establishment, or expansion, or the proposed construction, alteration, establishment, or expansion, of a structure or sanitary landfill, that the Secretary of Defense can demonstrate would— (A) endanger safety in air commerce directly related to the activities of the Department of Defense; (B) interfere with the efficient use of the navigable airspace directly related to the activities of the Department of Defense; or (C) significantly impair or degrade the capability of the Department of Defense to conduct training, research, development, testing, and evaluation, and operations or …
“national laboratories” applies in that section
The term “national laboratories” means— (A) each national security laboratory (as defined in section 3281(1) of the National Nuclear Security Administration Act ( 50 U.S.C. 2471(1) )); and (B) each national laboratory of the Department of Energy.

The term “participating agency” means a department or agency of the Federal Government that is represented on the Council by a member under subsection (b).;
