Before big spending on a reserve facility, the Secretary must notify Congress's defense committees. The department must then wait 21 days, or 14 after an electronic copy. Leased, already-authorized, and small repair projects are exempt from this wait.

(a) Congressional notification — Except as subsection (b) provides, an expenditure or contribution exceeding the amount in section 2805(b)(1) may not be made under section 18233 for any facility until: (1) the Secretary of Defense has notified the congressional defense committees of the facility's location, nature, and estimated cost; and (2) 21 days have passed since the committees received the notification — or, if sooner, 14 days have passed since a copy of the notification was provided electronically under section 480. (b) Certain expenditures or contributions exempted — Subsection (a) does not apply to: (1) facilities acquired by lease; (2) a project for a facility Congress already authorized, at the same location and for the same purpose as when authorized, if — based on bids received — (A) the project's Congress-approved scope of work isn't proposed to shrink by more than 25 percent, and (B) the current working cost estimate doesn't exceed the approved amount by more than the lesser of (i) 25 percent, or (ii) 200 percent of the maximum amount for a minor military construction project under section 2805(a); or (3) a repair project (as defined in section 2811(e)) that costs less than the amount specified in section 2811(d).
