10 U.S.C. § 6301 — Restriction on use of funds to pay penalties under environmental laws

(a) Funds appropriated to the Department of Energy for the Naval Nuclear Propulsion Program, nuclear weapons programs, or other atomic-energy defense activities may not pay a penalty, fine, or forfeiture imposed on a Department defense activity or facility for failing to meet an environmental requirement. (b) This restriction does not apply if: (1) the President did not request money to comply with the environmental requirement; or (2) Congress appropriated money for that purpose, the money was not sequestered, deferred, or rescinded, and the Secretary of Energy failed to use it for that purpose.
