16 U.S.C. § 1304Annual payment; adjustment

submitted 56 years ago by Pub. L. 91-559 to r/title-16-CONSERVATION · 227 words · no verdicts yet

in plain englishAI-generated · not legal advice

The Secretary pays an annual amount for a wetlands agreement and may pay part of conservation costs. Payments may be increased when the public receives specified access and adjusted when appropriation laws provide for it.

In exchange for the owner’s or operator’s agreement, the Secretary must (1) make annual payments during the agreement at rates the Secretary considers fair and reasonable for the promised obligations, and (2) pay the part of the average cost of establishing and maintaining conservation and development practices on the wetlands and adjacent areas that the Secretary considers appropriate. The Secretary must consider, among other things, the compensation needed to encourage participation in the water bank program. The Secretary may increase annual payments by an appropriate amount if the owner or operator allows the public, without other compensation, to enter the acreage during the agreement period for hunting, trapping, fishing, and hiking, subject to Federal and State rules. To the extent appropriation laws provide in advance, annual payments must be adjusted under section 1302.
