This chapter defines terms used in the Endangered Species Act, including alternative courses of action, commercial activity, conservation, critical habitat, species, taking, and related government and trade terms.

For this chapter: (1) “Alternative courses of action” means all alternatives, not only the original project goals and agency jurisdiction. (2) “Commercial activity” means all industry and trade activities, including buying or selling commodities and activities that facilitate those transactions, but not museums’ or similar cultural or historical organizations’ exhibitions of commodities. (3) “Conserve,” “conserving,” and “conservation” mean using all methods needed to bring an endangered or threatened species to the point where this chapter’s measures are no longer needed. These methods include scientific-resource management such as research, censuses, law enforcement, acquiring and maintaining habitat, propagation, live trapping, and transplantation. In the exceptional case where population pressure in an ecosystem cannot otherwise be relieved, they may include regulated taking. (4) “Convention” means the Convention on International Trade in Endangered Species of Wild Fauna and Flora, signed March 3, 1973, and its appendices. (5) “Critical habitat” for a threatened or endangered species means specific occupied areas that, when the species is listed under section 1533, contain physical or biological features essential to conservation and possibly requiring special management or protection; and specific unoccupied areas that the Secretary determines are essential to conservation. Critical habitat may be established for already listed species lacking it. Unless the Secretary determines otherwise, it does not include the entire area the species could occupy. (6) “Endangered species” means a species in danger of extinction throughout all or a significant part of its range, except a Class Insecta species the Secretary finds is a pest whose protection would create an overwhelming and overriding risk to people. (7) “Federal agency” means a United States department, agency, or instrumentality. (8) “Fish or wildlife” means any animal, including mammals, fish, birds—including migratory, nonmigratory, and endangered birds for which protection is also provided by a treaty or other international agreement—amphibians, reptiles, mollusks, crustaceans, arthropods, and other invertebrates. It also includes any part, product, egg, offspring, dead body, or part of a dead body. (9) “Foreign commerce” includes transactions between people in one foreign country, between people in two or more foreign countries, between a person in the United States and one in a foreign country, and between people in the United States when the fish or wildlife is moving outside the United States. (10) “Import” means landing on, bringing into, introducing into, or attempting any of those acts in a place under United States jurisdiction, whether or not customs law calls it an importation. (11) Repealed by the cited 1982 law. (12) “Permit or license applicant” means, for a Federal-agency action for which an exemption is sought under section 1536, a person whose permit or license application was denied mainly because of section 1536(a). (13) “Person” includes an individual; corporation; partnership; trust; association; other private entity; Federal, State, local, or foreign-government officer, employee, agent, department, or instrumentality; a State, municipality, or State political subdivision; and any other entity under United States jurisdiction. (14) “Plant” means any plant, including seeds, roots, and other parts. (15) “Secretary” generally means the Interior or Commerce Secretary according to Reorganization Plan No. 4 of 1970. For enforcing this chapter and the Convention’s rules on importing or exporting terrestrial plants, it also means the Agriculture Secretary. (16) “Species” includes a fish, wildlife, or plant subspecies and any distinct population segment of a vertebrate fish or wildlife species that interbreeds when mature. (17) “State” means a State, the District of Columbia, Puerto Rico, American Samoa, the Virgin Islands, Guam, or the Trust Territory of the Pacific Islands. (18) “State agency” means a State government agency, department, board, commission, or other entity responsible for managing and conserving fish, plant, or wildlife resources in a State. (19) “Take” means harass, harm, pursue, hunt, shoot, wound, kill, trap, capture, or collect, or try to do any of those things. (20) “Threatened species” means a species likely to become endangered throughout all or a significant part of its range in the foreseeable future. (21) When used geographically, “United States” includes all States.
