States receiving funds under this subchapter must align, limit, and identify their related rules and remove duplicative rules. Each State educational agency must create a practitioner committee with specified members to advise on State responsibilities and review rules, including emergency rules.

(a) Rulemaking. (1) Each State receiving funds under this subchapter must (A) ensure its related rules, regulations, and policies serve this subchapter’s purposes and submit proposed ones to the practitioner committee under subsection (b) for review and comment; (B) minimize the rules and policies imposed on local educational agencies and schools; (C) eliminate or change State and local fiscal-accounting requirements to help schools combine funds under schoolwide programs; (D) identify each such rule, regulation, or policy as a State-imposed requirement; and (E) identify duplicative or conflicting State and Federal requirements and eliminate State rules and regulations duplicating Federal requirements. (2) State rules, regulations, and policies under this subchapter must support and facilitate systemic reform at the local educational-agency and school levels so all children can meet challenging State academic standards. (b) Committee of practitioners. (1) Each State educational agency receiving funds under this subchapter must create a State committee of practitioners to advise the State about its responsibilities under this subchapter. (2) The committee must include (A) a majority of representatives of local educational agencies; (B) administrators, including administrators of programs in other parts of this subchapter; (C) teachers from traditional public schools and, if the State has them, charter schools, plus career and technical educators; (D) principals and other school leaders; (E) parents; (F) local school-board members; (G) representatives of private-school children; (H) specialized instructional-support personnel and paraprofessionals; (I) representatives of authorized public chartering agencies, if the State has charter schools; and (J) charter-school leaders, if the State has charter schools. (3) The committee must review every proposed or final State rule or regulation under this subchapter before publication. If an emergency rule must be issued within a very limited time to help local educational agencies operate the program, the State educational agency may issue it without prior consultation, but must immediately afterward convene the committee to review it before issuing it in final form.
