3 U.S.C. § 302 — Scope of delegation of functions

This section describes how far the President's delegation authority under this chapter reaches. That authority applies to any function the law gives the President, as long as the law does not specifically forbid delegating that function, or specifically name the officer or officers to whom it may be delegated. This chapter does not limit or take away any existing or inherent right the President already has to delegate the performance of functions the law gives the President. And nothing in this chapter requires express authorization in a case where an official would already be presumed by law to have acted under the President's authority or direction.
