This law gives active-duty dental officers several kinds of special pay. The amount depends on pay grade, years of service, and board certification. Officers who don't complete their agreed active-duty period must repay the extra pay.

(a) Variable, Additional, Board Certification, and Incentive Special Pay. (1) A dental officer of the Army or Navy Dental Corps, or an Air Force officer designated as a dental officer, who is on active duty under a call or order for at least one year, is entitled to special pay under this subsection. (2) An officer below pay grade O-7 gets variable special pay at set yearly rates based on years of creditable service and training status: $3,000 if in dental internship or with under 3 years of service; $7,000 with 3 to under 6 years and not interning; $7,000 with 6 to under 8 years; $12,000 with 8 to under 12 years; $10,000 with 12 to under 14 years; $9,000 with 14 to under 18 years; and $8,000 with 18 or more years. (3) An officer above pay grade O-6 gets $7,000 a year in variable special pay instead. (4) An officer getting variable special pay under (2) or (3) can also get additional special pay for any 12-month period covered by a signed active-duty agreement under subsection (b). The secretary sets the rate, capped at $10,000 a year for under 3 years of service, $12,000 for 3 to under 10 years, and $15,000 for 10 or more years. (5) An officer who is board certified and gets variable special pay can also get extra pay based on service: $2,500 with under 10 years, $3,500 with 10 to under 12, $4,000 with 12 to under 14, $5,000 with 14 to under 18, and $6,000 with 18 or more years. (6) An oral or maxillofacial surgeon among these officers may instead get incentive special pay at the same rates and conditions as medical officers get under section 302(b).

(b) Active-Duty Agreement. (1) To get the additional pay in (a)(4) or (a)(6), an officer must first sign an agreement to stay on active duty at least one year, starting when they accept the pay. (2) Under Secretary of Defense regulations, the relevant military department secretary may end that entitlement at any time; if ended, the officer must repay under section 303a(e).

(c) Regulations. The Secretary of Defense's regulations must set standards for deciding (1) whether an officer is in internship or residency training for purposes of (a)(2)(A), (a)(2)(B), and (a)(4), and (2) whether an officer is board certified for purposes of (a)(5).

(d) Frequency of Payments. Pay under (a)(2), (3), and (5) is paid monthly. Pay under (a)(4) or (6) is paid once a year, at the start of the 12-month period it covers.

(e) Repayment. An officer who doesn't finish the active-duty period in their (b) agreement must repay under section 303a(e).

(f) Determination of Creditable Service. To count an officer's creditable service, add together (1) all time spent in dental internship or residency training while not on active duty, and (2) all active-duty time served in the Army or Navy Dental Corps, as an Air Force dental officer, or as a Public Health Service dental officer.

(g) Reserve Dental Officers Special Pay. (1) A qualifying reserve dental officer gets $350 a month for each month of active duty, including annual training, active duty for training, and active duty for special work. (2) This applies to a reserve officer who (A) is a Dental Corps officer of the Army or Navy, or an Air Force officer designated as a dental officer, and (B) is on active duty under a call or order lasting less than one year.
