37 U.S.C. § 314 — Special pay or bonus: qualified members extending duty at designated locations overseas

(a) Covered Members. This section applies to a member of an armed force who (1) is entitled to basic pay; (2) has a specialty the Secretary concerned has designated for this section; (3) has finished a tour of duty, as defined by that Secretary's regulations, at a location outside the continental United States that the Secretary has designated; and (4) at the end of that tour, signs an agreement to extend it for at least one year. (b) Special Pay or Bonus Authorized. Once the Secretary concerned accepts the member's extension agreement, the member is entitled — at the Secretary's choice — to either (1) special pay in monthly installments, up to $80 per month; or (2) an annual bonus, up to $2,000 per year. (c) Selection and Payment of Special Pay or Bonus. No later than the date the Secretary accepts the extension agreement, the Secretary must tell the member whether they'll receive special pay or a bonus. The payment rate is fixed at the time of the agreement and can't change during the extended tour. The Secretary may pay the bonus as a lump sum or in installments. (d) Repayment. A member who signs an extension agreement, receives a bonus payment for a 12-month period covered by it, but then stops performing the agreed tour during that 12-month period, must repay the money under the repayment rules in section 303a(e) of this title. (e) Effect of Rest and Recuperative Absence. A member who chooses the rest-and-recuperation benefit under title 10, section 705(b), as part of the tour extension isn't entitled to the monthly special pay under subsection (b)(1) for that extension period.
