submitted 71 years ago by Pub. L. 95-95 to r/title-42-THE-PUBLIC-HEALTH-AND-WELFARE · 150 words · no verdicts yet
Each implementation plan must require public-interest majorities on boards that approve permits or enforcement orders and disclosure of potential conflicts. States may adopt stricter conflict-of-interest rules, which the Administrator must approve when submitted in a plan.
Not later than one year after August 7, 1977, each applicable plan must require: (1) any board or body approving permits or enforcement orders under this chapter to have at least a majority representing the public interest and not receiving a significant part of its income from permit or order subjects; and (2) adequate disclosure of potential conflicts by board or body members and executive-agency heads with similar powers. A State* may adopt stricter conflict rules for these officials or other entities, and the Administrator* must approve stricter rules submitted as part of an implementation plan.
1 Not later than the date one year after August 7, 1977, each applicable implementation plan* shall contain requirements that—
any board or body which approves permits or enforcement orders under this chapter shall have at least a majority of members who represent the public interest and do not derive any significant portion of their income from persons subject to permits or enforcement orders under this chapter, and
any potential conflicts of interest by members of such board or body or the head of an executive agency with similar powers be adequately disclosed.
A State* may adopt any requirements respecting conflicts of interest for such boards or bodies or heads of executive agencies, or any other entities which are more stringent than the requirements of paragraph (1) and (2), and the Administrator* shall approve any such more stringent requirements submitted as part of an implementation plan.
