46 U.S.C. § 70031 — Definitions

As used in subchapters I through III and this subchapter, unless context requires otherwise: (1) "Marine environment" means: the navigable waters of the United States, and the land and resources in and under them; the waters and fishery resources of any area where the United States claims sole fishery management authority; the seabed, subsoil, and resources of the U.S. Outer Continental Shelf, and the waters above it; and the recreational, economic, and scenic value of these waters and resources. (2) "Secretary" means the head of the department running the Coast Guard — except that for applying this chapter to the Saint Lawrence Seaway, "Secretary" means the Secretary of Transportation instead. (3) "Navigable waters of the United States" includes all waters of the U.S. territorial sea, as described in Presidential Proclamation No. 5928 of December 27, 1988.
