5 U.S.C. § 8431 — Certain transfers to be treated as a separation
submitted 27 years ago by Pub. L. 106-168 to r/title-5-GOVERNMENT-ORGANIZATION-AND-EMPLOYEES · 86 words · no verdicts yet
This law defines what counts as leaving government employment for retirement purposes. It happens when you transfer out of a covered retirement system into an uncovered job. Covered systems include this plan, the old civil-service system, and other Thrift Savings Fund plans.
(a) For this subchapter, "separation from Government* employment" includes a transfer. This happens when someone moves from a job covered by one of the retirement systems listed in subsection (b) to a job that isn't covered by any of them. Even though the person keeps working for the government, the move counts as a separation for the rules in this subchapter.
(b) The retirement systems this rule applies to are:
(1) The retirement system* created by this chapter (the Federal Employees Retirement System).
(2) The retirement system in subchapter III of chapter 83 (the older Civil Service* Retirement System).
(3) Any other retirement system that lets people put money into the Thrift Savings Fund* by having it taken out of their pay.
For purposes of this subchapter, separation from Government* employment includes a transfer from a position that is subject to one of the retirement systems described in subsection (b) to a position that is not subject to any of them.
The retirement systems described in this subsection are—
the retirement system* under this chapter;
the retirement system under subchapter III of chapter 83; and
any other retirement system under which individuals may contribute to the Thrift Savings Fund* through withholdings from pay.
