54 U.S.C. § 100101 — Promotion and regulation
submitted 12 years ago by Pub. L. 113-287 to r/title-54-NATIONAL-PARK-SERVICE-AND-RELATED-PROGRAMS · 341 words · no verdicts yet
This law directs the National Park Service to manage the National Park System. Parks must be conserved for public enjoyment now, while staying unimpaired for future generations. Congress says park management must follow this purpose, unless Congress specifically says otherwise.
(a) In General. The Secretary* of the Interior, acting through the Director* of the National Park Service*, must promote and regulate use of the National Park System*. Every rule and action must fit the System's fundamental purpose: to conserve the scenery, and the natural and historic objects and wildlife, in the System's units — and to let people enjoy that scenery, those objects, and that wildlife — in ways that leave them unimpaired for future generations to enjoy.
(b) Declarations.
(1) 1970 declarations. Congress declares that: (A) the National Park System*, which began with Yellowstone National Park in 1872, has grown to include outstanding natural, historic, and recreational areas across every major region of the United States and its territories and possessions; (B) though each area is distinct, their related purposes and resources unite them into one National Park System, expressing one shared national heritage; (C) being included together in one System, managed for the benefit and inspiration of all Americans, gives these areas added national importance and recognition of their outstanding environmental quality; and (D) this division's purpose is to include all these areas in the System, and to clarify the legal authorities that apply to it.
(2) 1978 reaffirmation. Congress reaffirms, declares, and directs that promoting and regulating the System's units must be consistent with, and grounded in, the purpose set out in subsection (a), for the common benefit of all Americans. Any authorized activity must be interpreted, and the System's protection, management, and administration must be carried out, in light of the System's high public value and integrity. None of this may be done in a way that undercuts the values and purposes for which the System's units were established — except when Congress directly and specifically allows it.
The Secretary*, acting through the Director* of the National Park Service*, shall promote and regulate the use of the National Park System* by means and measures that conform to the fundamental purpose of the System* units, which purpose is to conserve the scenery, natural and historic objects, and wild life in the System units and to provide for the enjoyment of the scenery, natural and historic objects, and wild life in such manner and by such means as will leave them unimpaired for the enjoyment of future generations.
Congress declares that—
the National Park System, which began with establishment of Yellowstone National Park in 1872, has since grown to include superlative natural, historic, and recreation areas in every major region of the United States and its territories and possessions;
these areas, though distinct in character, are united through their interrelated purposes and resources into one National Park System as cumulative expressions of a single national heritage;
individually and collectively, these areas derive increased national dignity and recognition of their superb environmental quality through their inclusion jointly with each other in one System preserved and managed for the benefit and inspiration of all the people of the United States; and
it is the purpose of this division to include all these areas in the System and to clarify the authorities applicable to the System.
Congress reaffirms, declares, and directs that the promotion and regulation of the various System units shall be consistent with and founded in the purpose established by subsection (a), to the common benefit of all the people of the United States. The authorization of activities shall be construed and the protection, management, and administration of the System units shall be conducted in light of the high public value and integrity of the System and shall not be exercised in derogation of the values and purposes for which the System units have been established, except as directly and specifically provided by Congress.
