The Secretary must write rules for approving State Historic Preservation Programs. A State's program qualifies if it has a State-appointed preservation officer with qualified staff, an adequate review board, and real public participation, including in nominating properties to the National Register.

The Secretary must write regulations for State Historic Preservation Programs, working with the National Conference of State Historic Preservation Officers and the National Trust. Under these regulations, the Secretary must approve a State's program if it provides for three things: (1) the State's top elected official appoints a State Historic Preservation Officer to run the program under section 302303 of this title, and that Officer hires or appoints qualified staff as needed; (2) the State Historic Preservation Officer sets up an adequate, qualified State historic preservation review board, unless State law says someone else does; and (3) the public gets to meaningfully participate in the State program, including in recommending properties for the National Register.
