7 U.S.C. § 20 — Market reports

(a) Information The Commission may regularly investigate the markets for goods, articles, services, rights, and interests that are the subject of futures contracts. It can publish reports of what it finds, on a regular basis, for the public. Where appropriate, these reports include information about supply, demand, prices, and other conditions — in the United States and other countries — for those goods, articles, services, rights, and interests, along with information about the futures markets themselves. (b) Avoidance of duplication The Commission must work with the Department of Agriculture, and any other department or federal agency that also makes market investigations, to avoid unnecessary duplication of information-gathering. (c) Furnishing of information; confidentiality If the Department of Agriculture or another federal agency has market information the Commission wants, it must give that information to the Commission when an authorized Commission employee requests it. The Commission must follow any confidentiality rules that apply to that information. (d) Disclosure of business transactions, market positions, trade secrets, or names of customers The Commission's reports may not disclose data or information that would separately reveal any person's business transactions or market positions, or reveal trade secrets or customer names — except as provided in section 12 of this title. (e) Application This section does not apply to investigations involving any security underlying a security futures product.
