submitted 110 years ago by Pub. L. 106-472 to r/title-7-AGRICULTURE · 167 words · no verdicts yet
A warehouse must deliver stored farm products promptly, without a lawful excuse. Before delivery, the operator may require payment of storage charges and any lien. The receipt holder must surrender the receipt, which the warehouse then cancels.
(a) Prompt delivery: Unless the warehouse operator* has a lawful excuse, it must deliver the stored agricultural product* without unnecessary delay when either (1) the holder* of the receipt*, or (2) the person* who deposited the product (if no receipt was issued), demands it.
(b) Payment to accompany demand: Before delivering the product, the operator may require payment of the accrued charges from storing the product, including satisfying the warehouseman's lien, if the operator asks for it.
(c) Surrender of receipt: When a receipt holder asks for delivery of a product the receipt covers, the holder must give the receipt back to the warehouse* operator, in the way the Secretary* prescribes, to get the product.
(d) Cancellation of receipt: The warehouse operator must cancel each receipt once it's returned upon delivering the product it covered.
In the absence of a lawful excuse, a warehouse operator* shall, without unnecessary delay, deliver the agricultural product* stored or handled in the warehouse* on a demand made by—
the holder* of the receipt* for the agricultural product; or
the person* that deposited the product, if no receipt has been issued.
Prior to delivery of the agricultural product, payment of the accrued charges associated with the storage of the agricultural product, including satisfaction of the warehouseman’s lien, shall be made if requested by the warehouse operator.
When the holder of a receipt requests delivery of an agricultural product covered by the receipt, the holder shall surrender the receipt to the warehouse operator, in the manner prescribed by the Secretary*, to obtain the agricultural product.
A warehouse operator shall cancel each receipt returned to the warehouse operator upon the delivery of the agricultural product for which the receipt was issued.
