in plain englishAI-generated · not legal advice

This section assigns responsibility for administering the chapter to the appropriate Secretaries and assigns responsibility for TRICARE to the Secretary of Defense. It also requires a stable benefits program, subject to an exception for an important improvement in care.

(a)(1) Unless this chapter says otherwise, the Secretary of Defense administers it for the armed forces under that Secretary’s authority; the Secretary of Homeland Security administers it for the Coast Guard when the Coast Guard is not operating as part of the Navy; and the Secretary of Health and Human Services administers it for the National Oceanic and Atmospheric Administration and the Public Health Service. Administration must comply with the Assisted Suicide Funding Restriction Act of 1997. (2) Unless this chapter says otherwise, the Secretary of Defense administers TRICARE and makes decisions affecting it. (b) The Secretary of Defense must provide, as far as practicable, a stable benefits program throughout each fiscal year. Managed-care support contracts must put benefit and administrative changes into effect quarterly. The Secretary may put a change into effect before the next quarter if the Secretary decides it would significantly improve care for eligible beneficiaries.

To achieve the stability in the case of managed care support contracts entered into under this chapter, the contracts shall be administered so as to implement all changes in benefits and administration on a quarterly basis. However, the Secretary of Defense may implement any such change prior to the next fiscal quarter if the Secretary determines that the change would significantly improve the provision of care to eligible beneficiaries under this chapter.
